dc.description.abstract	ศึกษาและวิเคราะห์ถึงมาตรการทางกฎหมาย และอำนาจหน้าที่ขององค์กรที่มีความเกี่ยวข้อง กับการจัดการและการพิทักษ์แนวปะการังในประเทศไทย ตลอดไปจนถึงโอกาสและบทบาทในการเข้ามามีส่วนร่วม เพื่อการจัดการและการพิทักษ์ทรัพยากรแนวปะการังโดยประชาชน ผลการศึกษาวิจัยพบว่า มาตรการทางกฎหมายที่ใช้ในการจัดการ และการพิทักษ์แนวปะการังในปัจจุบันยังคงมีข้อบกพร่อง และไม่ครอบคลุมในการแก้ไขปัญหาบางประการ ตลอดจนกระบวนการในการบังคับใช้กฎหมายที่มีอยู่ ก็ยังไม่มีประสิทธิภาพมากเพียงพอ ที่จะใช้ในการแก้ไขปัญหาการถูกทำลายของทรัพยากรแนวปะการัง ส่วนบทบาทการดำเนินงานขององค์กร ที่เกี่ยวข้องกับการจัดการและการพิทักษ์แนวปะการัง ทั้งองค์กรภาครัฐและเอกชนก็ยังคงขาดความชัดเจนไม่ต่อเนื่อง และขาดการประสานงานร่วมกันในลักษณะที่มีสหสัมพันธ์ระหว่างกัน นอกจากนี้ประชาชนส่วนใหญ่ยังไม่ได้เข้ามามีส่วนร่วมกับองค์กรภาครัฐ ในการคุ้มครองดูแลแหล่งทรัพยากรแนวปะการังมากเท่าที่ควร ซึ่งสภาพปัญหาต่างๆ เหล่านั้นล้วนแต่ทำให้กระบวนการในการจัดการ และการพิทักษ์แนวปะการังในประเทศไทย ยังคงไม่มีประสิทธิภาพมากเท่าที่ควร จากสภาพปัญหาดังกล่าว ผู้วิจัยจึงได้เสนอแนะ ให้มีการปรับปรุงแก้ไขบทบัญญัติของกฎหมาย ที่ยังคงมีข้อบกพร่องเพื่อให้มีความเหมาะสม มากกว่าที่เป็นอยู่ในปัจจุบัน และยังได้นำเสนอแนวทางในการนำวิธีการเพื่อความปลอดภัย มาใช้บังคับควบคู่ไปกับการลงโทษตามกฎหมาย ต่อผู้ที่ทำลายทรัพยากรแนวปะการังตามกฎหมาย ตลอดจนแนวทางในการบังคับใช้กฎหมาย เพื่อให้สามารถนำไปใช้แก้ไขปัญหาการถูกทำลาย ของทรัพยากรแนวปะการังได้อย่างมีประสิทธิภาพมากยิ่งขึ้น พร้อมทั้งนำเสนอแนวทางในการกำหนดบทบาทหน้าที่ การดำเนินงานขององค์กรภาครัฐที่มีความเกี่ยวข้องกับ การจัดการและการพิทักษ์แนวปะการัง เพื่อให้มีความชัดเจนและเป็นแนวทางเดียวกัน และเสนอการนำมาตรการในการจัดการทรัพยากรแนวปะการัง ที่มีความเหมาะสมมาปรับใช้ เช่น การจัดกิจกรรมการท่องเที่ยวเชิงอนุรักษ์ภายในแหล่งทรัพยากรแนวปะการัง เป็นต้น หรือการเร่งประชาสัมพันธ์เผยแพร่ ให้ประชาชนตระหนักถึงความสำคัญของทรัพยากรแนวปะการังตามธรรมชาติ ตลอดจนส่งเสริมประชาชนได้เข้ามามีส่วนร่วมกับภาครัฐ ในการจัดการและพิทักษ์แนวปะการังของประเทศแล้ว ก็เป็นอีกแนวทางหนึ่งที่ได้นำมาปรับใช้ เพื่อให้ทรัพยากรแนวปะการังในประเทศไทย ได้รับการคุ้มครองดูแลอย่างมีประสิทธิภาพมากยิ่งขึ้นต่อไป	en
dc.description.abstractalternative	To study and analyse legal measures and authority of organization involving the management and preservation of the coral reefs in Thailand. It also concentrates on how public get a chance to involve and participate in that said matter. The outcome of this research indicates that legal measure for management and preservation of the coral reefs in Thailand nowadays have some drawbacks and are ineffective to redress problems. Also the legal enforcement process is ineffective to solve the problem of the deterioration of the coral reefs which is due to the lack of the common goal and intention to work together between the government and non-government organization. Importantly, the majority of the public still have few chances and channels to get involve with government organization to protect the coral reefs in Thailand. From the above problems these make the process of management and preservation the coral reefs in Thailand ineffective. The above mentioned problems, therefore, the researcher recommends to propose these following recommendation : 1. Amending the flawed or ineffective provision of the law. 2. Useing both measures of safety and legal punisment simultaneously to violators. 3. Improving legal enforcement procedure to be more effective. 4. Destinating the certain role and authority of government organization with directly involve which this matter. 5. Conducting campaign to the coral reefs management such as Eco-tourism, etc. Lastly, the vital point to be addressed here is to promote and support the public paticipation which make this process more efficiency and transparency are also the additional recommendation.	en
