dc.description.abstract	การวิจัยนี้มีจุดมุ่งหมาย เพื่อศึกษาถึงมาตรการทางกฎหมายที่ใช้บังคับการฟื้นฟูพื้นที่ที่ผ่านการทำเหมืองแร่แล้ว โดยศึกษาวิเคราะห์เฉพาะการทำเหมืองแร่บนบกที่กำลังดำเนินการอยู่ในปัจจุบัน จากการศึกษาพบว่า เมื่อมีการเลิกการทำเหมืองแร่แล้ว ผู้ถือประทานบัตรส่วนใหญ่จะไม่ทำการฟื้นฟูพื้นที่ผ่านการทำเหมืองแร่แล้ว ปัญหาดังกล่าวเกิดจากบทบัญญัติกฎหมายที่ใช้ควบคุมยังไม่เหมาะสม ขาดความชัดเจน และการบังคับใช้กฎหมายไม่มีประสิทธิภาพเท่าที่ควร การวิจัยเรื่องนี้จึงได้เสนอให้มีการปรับปรุงแก้ไขบทบัญญัติของกฎหมาย สภาพการบังคับใช้กฎหมาย และองค์กรในการควบคุมดูแล ในด้านบทบัญญัติของกฎหมาย ควรกำหนดให้ผู้ถือประทานบัตร จัดทำแผนการฟื้นฟูพื้นที่ที่ผ่านการทำเหมืองแร่แล้ว เพื่อเป็นแนวทางในการฟื้นฟูพื้นที่ฯ และต้องรับผิดค่าใช้จ่ายที่เกิดขึ้นทั้งหมด ห้ามมิให้ผู้ที่กระทำความผิดไม่ทำการฟื้นฟูพื้นที่ฯ ยื่นขอประทานบัตร ออกกฎหมายรองรับมาตรการการวางหนังสือค้ำประกันของธนาคารหรือสถาบันการเงินเพื่อประกันการฟื้นฟู พื้นที่ฯ กำหนดมาตรฐานน้ำทิ้งเหมืองแร่ให้เหมาะสมยิ่งขึ้น ยกเลิกอำนาจของรัฐมนตรีว่าการกระทรวงอุตสาหกรรมที่อนุญาตให้ปล่อยน้ำทิ้งเหมืองแร่เกินมาตรฐานที่กำหนดได้ ยกเลิกการอนุญาตให้ปล่อยน้ำทิ้งเหมืองแร่ลงในทางน้ำสาธารณะบางแห่งและทะเลโดยเสรี กำหนดให้ผู้ถือประทานบัตรต้องรับผิดค่าใช้จ่ายในการฟื้นฟูสภาพแวดล้อมที่เกิดจากแร่ที่มีพิษ และกำหนดให้กรรมการหรือผู้จัดการนิติบุคคลและวิศวกรต้องร่วมรับผิดด้วย ในด้านการบังคับใช้กฎหมาย กรมทรัพยากรธรณีและกรมป่าไม้ควรตรวจสอบและสั่งการให้ผู้ถือประทานบัตร ทำการฟื้นฟูพื้นที่ที่ผ่านการทำเหมืองแร่แล้วตามอำนาจที่ให้ไว้ในกฎหมายและระเบียบข้อบังคับ ตลอดจนตามเงื่อนไขในการอนุญาตให้ทำเหมืองโดยเคร่งครัด และดำเนินการฟื้นฟูพื้นที่ฯ ในกรณีที่ผู้ถือประทานบัตรไม่ดำเนินการ โดยให้ผู้ถือประทานบัตรรับผิดชดใช้ค่าใช้จ่าย หรือใช้จ่ายจากเงินค่าปลูกป่าที่กรมป่าไม้ได้จัดเก็บไว้ในการอนุญาตให้ทำเหมืองแร่ในพื้นที่ป่าไม้ ในด้านองค์กรในการควบคุมดูแล กำหนดให้สภาตำบลหรือองค์การบริหารส่วนตำบล และองค์การบริหารส่วนจังหวัดเข้ามามีส่วนร่วมในการติดตามตรวจสอบด้วยกำหนดมาตรฐานควบคุมมลพิษจากแหล่งกำเนิดในพื้นที่ที่ผ่านการทำเหมืองแร่แล้ว เพื่อให้กรมควบคุมมลพิษเข้าตรวจสอบแก้ไขปัญหาได้ ในด้านบทบาทของประชาชน ควรออกกฎหมายกำหนดให้มีการฟ้องคดีสิ่งแวดล้อมโดยประชาชน และมีการทำประชาพิจารณ์ในการจัดทำรายงานการวิเคราะห์ผลกระทบสิ่งแวดล้อม	en
dc.description.abstractalternative	This research intends to examine legal measures to force reclamation of spoiled mines by analysing the operation mines on land. From the study, it has found that after completing of the mine, most of the concessionaires have neglected to reclaim the mine-spoiled area. This is due to the inadequacy and ineffectiveness of law enforcement. This research proposes an amendment to the law, law enforcement and the authorization of law. The concessionaire must be fully responsible for the said reclamation as well as set up plan to form the direction of measures and bear all the expenses. Those who do not comply with the regulations will not obtain future concessions. There should be a law to enforce the bank or financial guarantor to assure the reclamation. Standardized methods to deal with wastewater should be set up more proper. The authority of the Minister of Industry regarding the concessionaire to release wastewater more than allowed into public waterways should be abolished. The concessionaire must also be responsible to restore environment endangered by toxic minerals and make the directors or managers of such juristic person be joint liability. In implementing and enforcing the law, the Department of Mineral Resources and the Department of Forestry should inspect and order the concessionaire to restore land that was mined according to law and regulations and restore land that the concessionaire did not comply with the regulations by making the concessionaire responsible for the expenses or use the money that collect from the Department of Forestry to plant trees. The Department of Mineral Resources should speed up the inspection of land reclamation by setting out responsibilities of Municipalities and Provincial Administration Organizations. The Department of Pollution Control should set standards to control the toxic waste from the point sources pollution so that Department can inspect and solve the problems. For the role of the people, laws should be issued for citizen suit in order to preserve the environment and for public hearings to prepare the environmental impact assessment.	en
