| dc.description.abstract | การวิจัยครั้งนี้ มีจุดมุ่งหมายเพื่อหามาตรการทางกฎหมายมาคุ้มครองประชาชนที่ซื้อที่ดินจัดสรรมิให้ถูกเอารัดเอาเปรียบจากการจัดสรรที่ดินของเอกชน ผลการวิจัยพบว่าบทบัญญัติตามประกาศคณะปฏิวัติฉบับที่ 286 (พ.ศ. 2515) ที่ใช้บังคับอยู่ในปัจจุบัน ขาดมาตรการที่จะให้การคุ้มครองสิทธิของผู้ซื้อที่ดินจัดสรรอยู่สี่ประการสำคัญด้วยกัน ผู้เขียนจึงได้เสนอแนะมาตรการแก้ไขปัญหาต่างๆ เหล่านั้น กล่าวโดยสรุปคือ ควรจะมีการแก้ไขเพิ่มเติมประกาศคณะปฏิบัติ ฉบับที่ 286 (พ.ศ. 2515) ซึ่งเป็นกฎหมายที่ใช้การควบคุมการจัดสรรที่ดินของเอกชนอยู่ในขณะนี้ให้สามารถคุ้มครองสิทธิประโยชน์ของผู้ซื้อที่ดินจัดสรร ตั้งแต่การคุ้มครองด้านการโฆษณา การทำนิติกรรมสัญญา การป้องกันการสูญเสียเงินที่ชำระล่วงหน้าแก่ผู้จัดสรรที่ดิน รวมทั้งการจัดทำและดูแลรักษาสาธารณูปโภคต่างๆ ในที่ดินจัดสรร | en_US |
| dc.description.abstractalternative | The purpose of this research is to find legal measures to protect people from exploitation by land allotment done by private sector. The results of the research discover that the provision in the Revolutionary Announcement No. 286 (B.E. 2515), enforceable at present, lacks of 4 major measures to protect the rights of people who buy the allotted land. Therefore, the researcher has proposed measures as the solutions to the problems. To sum up, this Revolutionary Announcement should be amended in order to protect people who buy the allotted land in these matters ; advertisement, making contract, earnest money, including public utility management. | en_US |
