dc.description.abstract	ศึกษาที่มาและสภาพการรับรองสิทธิเสรีภาพที่เกิดขึ้นในช่วงสมัยแห่ง พระบาทสมเด็จพระจอมเกล้าเจ้าอยู่หัว ถึง พระบาทสมเด็จพระปกเกล้าเจ้าอยู่หัว อันเป็นการปกครองภายใต้ระบบสมบูรณาญาสิทธิราชย์ สภาพสังคมแต่เดิมนั้นอยู่ภายใต้ระบอบชนชั้นมีการแบ่งชนชั้นอย่างเห็นได้ชัด อันปรากฏกฎหมายที่ให้การรับรองสิทธิเสรีภาพ ซึ่งมีลักษณะการให้การรับรองสิทธิเสรีภาพของชนชั้นจำแนกแตกต่างมากน้อยตามลำดับชนชั้นที่เป็นอยู่ และในช่วงการปกครองของ 4 รัชกาลดังกล่าว เกิดการพัฒนาการของกฎหมายที่ให้การรับรองสิทธิเสรีภาพระบบชนชั้นเกิดการคลายความตรึงตัวลง ทำให้กฎหมายที่ให้การรับรองสิทธิเสรีภาพนั้นผ่อนคลายตัวลงในเรื่องความแตกต่างของชนชั้นไปตามลำดับด้วย ผลการศึกษาพบว่า ประเทศไทยในเวลาดังกล่าว ได้มีการเผยแพร่แนวความคิดทางด้านกฏหมายที่เกี่ยวกับสิทธิและเสรีภาพให้แก่ประชาชนทุกๆ ชนชั้น ทั้งชนชั้นผู้ปกครอง กลุ่มขุนนางและชนชั้นสามัญโดยการประกาศกฏหมายต่างๆ ในราชกิจจานุเบกษาเพื่อให้ทุกคนได้รับทราบ ซึ่งทำให้เกิดผลในทางกฏหมายตามมาหลายประการ ลักษณะการให้การรับรองสิทธิเสรีภาพ จะปรากฏในลักษณะการกำหนดจากเบื้องบนมากกว่าจะเกิดจากความต้องการของประชาชนทั่วไป แต่อย่างไรก็ตามพบว่า ลักษระการให้การรับรองสิทธิเสรีภาพที่เกิดขึ้นนั้น ถือว่าเพียงพอและสนองความต้องการของประชาชนในแต่ละช่วงสมัยได้ในระดับหนึ่ง และแนวพระราชดำริของพระมหากษัตริย์ทุกพระองค์ ก็แสดงถึงการปูพื้นฐานและพยายามให้เสรีภาพแก่ประชาชน เพื่อพัฒนาการปกครองประเทศสู่ระบอบประชาธิปไตยในสมัยต่อมา จะเห็นได้ว่าปัจจุบันปัจจัยที่สำคัญในการกำหนดแนวทางการรับรองสิทธิเสรีภาพ จะแปรผันตามกับทัศนคติของผู้ใช้อำนาจปกครอง ซึ่งไม่ได้แตกต่างจากสมัยที่ปกครองโดยระบบสมบูรณาญาสิทธิราชย์แต่อยางใด หากผู้ใช้อำนาจมีแนวคิดที่มุ่งคุ้มครองสถานภาพความเป็นอยู่ของประชาชน และประชาชนก็พยายามและศึกษาทำความเข้าใจกับบทบัญญัติที่ให้การรับรองสิทธิเสรีภาพ การพัฒนาการของการรับรองสิทธิเสรีภาพย่อมจะพัฒนา และตอบสนองความต้องการของประชาชนได้อย่างมีประสิทธิภาพต่อไป	en
dc.description.abstractalternative	To study at the sources and recognition of rights and liberty during the reign of King Rama IV to King Rama VII that is ruled under absolute monarchy administration. Social state in that time being under class system which obviously class division, occurring in the law that provide recognition of rights and liberty of class according to status where the class be. The aforesaid reign mentioned above had been provided development of law concerning the recognition of rights and liberty which relieved intense compulsory of law in that period. It also made the law hereof relieving from intense state between class in social too. Results getting from studying found that was propagation of comceptual law concerning rights and liberty to people in every in classes on that time in Thailand by promulgation laws in government gazette. It also had many consequences in law aspect. However, characteristic of the recognition occurring that time is enough and respond to a requiring of people in each reign at least in satisfied level. The every King's idea showing foundation and attempt for providing liberty to people in order to develop the administrative of this country for democratic adminstration afterward. Nowadays, the important elements that set up the means of recognition of rights and liberty will shift upon the attitude of governor that is not differ from the reign of absolute monarchy administration. If governor has concept to protect status of people and people also try to study and understans with the provision of law regarding the recognition of rights and liberty, it can develop and respond to the requiring of people in efficient manner.	en
