| Abstract: | ศึกษาอนุสัญญาสากลไปรษณีย์และพิธีสารต่อท้าย ค.ศ. 2008 โดยเป็นการวิเคราะห์ถึงกรณีการเป็นภาคีของประเทศไทย เพื่อเป็นแนวทางในการปรับปรุงกฎหมาย และกลไกในการดูแลและควบคุมบริการไปรษณีย์ให้มีประสิทธิภาพยิ่งขึ้น จาการศึกษาพบว่า อนุสัญญาสากลไปรษณีย์และพิธีสารต่อท้าย ค.ศ. 2008 เป็นเครื่องมือสำคัญในการกำหนดหลักเกณฑ์การให้บริการไปรษณีย์ระหว่างประเทศ โดยมีหลักการเพิ่มเติมในสามเรื่องคือ การเพิ่มความคุ้มครองแก่ผู้ใช้บริการและพนักงานไปรษณีย์ การต่อต้านการใช้ช่องทางไปรษณีย์ในการส่งสิ่งผิดกฎหมาย และการนำเทคโนโลยีมาใช้ในการอำนวยความสะดวกให้แก่ผู้ใช้บริการ นอกจากนี้ยังพบว่ากฎหมายว่าด้วยไปรษณีย์ของประเทศไทยที่ใช้บังคับอยู่ในปัจจุบัน ได้แก่ พระราชบัญญัติไปรษณีย์ พ.ศ. 2477 และไปรษณีย์นิเทศ พ.ศ. 2553 ยังมีข้อบกพร่องที่จำต้องได้รับการปรับปรุงให้สอดคล้องกับหลักการของอนุสัญญาดังกล่าวอยู่พอสมควร ผู้เขียนได้เสนอกลไกในการแก้ไขปัญหาที่สำคัญ โดยประเทศไทยสมควรนำหลักการเพิ่มเติมของอนุสัญญาสากลไปรษณีย์และพิธีสารต่อท้าย ค.ศ. 2008 ในสามเรื่องดังกล่าวข้างต้นมาเป็นแนวทางในการปรับปรุงกฎหมาย และกลไกต่างๆ เกี่ยวกับบริการไปรษณีย์ของประเทศไทย เพื่อให้ความร่วมมือระหว่างประเทศในการให้บริการไปรษณีย์เป็นไปอย่างมีประสิทธิภาพ |
| Other Abstract: | To study the Universal Postal Convention and Final Protocol 2008 by means of analyzing the case of Thailand as a state party to this convention, to be used as guidelines in legislative amendments and mechanism for monitoring postal service with a view to improving its effectiveness. This study found that the Universal Postal Convention and Final Protocol 2008 has an important part in regulating international postal service with three additional principles – providing higher protection to customers and postal employees, taking measures against illegal trafficking via postal service and applying new technologies in the facilitation of customer service. Furthermore, the currently effective laws in regard to Thailand’s postal service, which are the Postal Act B.E. 2477 and Postal Directive B.E. 2553, still have considerable problems and need proper revision in accordance with the convention. The author has proposed the mechanism for solving major problems by encouraging Thailand to use the above–mentioned principles of the Universal Postal Convention and Final Protocol 2008 as guidelines in legislative amendments and mechanism regarding Thailand’s postal service to enhance international cooperation on postal service |
