| dc.description.abstract | หลัก Rebus Sic Stantibus เป็นข้อยกเว้นของหลัก Pacta Sunt Servanda ที่ปรับใช้เพื่อยกเลิก แก้ไข ระงับ หรือปรับเปลี่ยน ความตกลง ที่มีพฤติการณ์เปลี่ยนแปลงไปอย่างมีนัยสำคัญภายหลังจากที่ความตกลงนั้นได้ทำขึ้น โดยคู่สัญญามิอาจคาดหมายได้ล่วงหน้าในขณะที่ทำความตกลงกัน วิทยานิพนธ์ฉบับนี้มุ่งศึกษาการปรับใช้ หลัก Rebus Sic Stantibus ภายใต้กฎหมายระหว่างประเทศ เพื่อพิจารณาว่าสามารถปรับใช้กับกฎหมายจารีตประเพณีระหว่างประเทศได้หรือไม่ เนื่องจากกฎหมายจารีตประเพณีระหว่างประเทศมีลักษณะเป็นความตกลงประเภทหนึ่ง คือความตกลงโดยปริยาย และหากปรับใช้ได้ย่อมสามารถปรับใช้กับกฎหมายระหว่างประเทศในเรื่องการป้องกันตนเองที่มีลักษณะเป็นกฎหมายจารีตประเพณีระหว่างประเทศได้เช่นกัน ทั้งนี้ เพื่อเป็นการปรับหลักเกณฑ์ของการป้องกันตนเองให้สามารถใช้กับการป้องกันตนเองล่วงหน้าได้ เนื่องจากกฎหมายระหว่างประเทศในเรื่องการป้องกันตนเองในปัจจุบันไม่เพียงพอที่จะรับมือกับภัยคุกคามรูปแบบใหม่ เช่น ภัยคุกคามจากตัวกระทำการที่ไม่ใช่รัฐ และอาวุธที่มีอานุภาพทำลายล้างสูง จากการศึกษาพบว่า หลัก Rebus Sic Stantibus สามารถนำมาปรับใช้กับกฎหมายจารีตประเพณีระหว่างประเทศได้ เพราะว่ากฎหมายจารีตประเพณีระหว่างประเทศมีลักษณะเป็นความตกลงโดยปริยาย และหลัก Rebus Sic Stantibus สามารถปรับใช้ได้กับความตกลงทุกประเภท ดังนั้นเมื่อหลัก Rebus Sic Stantibus สามารถปรับใช้กับกฎหมายจารีตประเพณีระหว่างประเทศได้ ย่อมนำมาปรับใช้กับกฎหมายจารีตประเพณีระหว่างประเทศว่าด้วยการป้องกันตนเองได้เช่นกัน โดยมีลักษณะการปรับใช้เพื่อเปลี่ยนแปลงหลักเกณฑ์ของการป้องกันตนเอง เพื่อเป็นฐานทางกฎหมายของหลักการป้องกันตนเองล่วงหน้า | en_US |
| dc.description.abstractalternative | Rebus Sic Stantibus Principle is an exception of Pacta Sunt Servanda Principle which is applied to terminate, revise, suspend or modify an agreement that encounters fundamental change of circumstances unforeseen by each party at the time of having concluded the agreement. The thesis aims at studying the application of Rebus Sic Stantibus Principle in the international law to, firstly, Customary International Law and, later, to Self-Defense in Customary International Law. The argument is if Rebus Sic Stantibus Principle may be applied to the Customary International Law due to the fact that the Customary International Law is considered to be a kind of an agreement, i.e., a tacit agreement, then Rebus Sic Stantibus Principle may also be applied to Self-Defense in Customary International Law in a case of Preemptive Self-Defense. The main reason is, presently, it is found that Self-Defense in International Law is not sufficient to deal with the new threats such as those from non-state actors and weapons of mass destruction. The study shows that Rebus Sic Stantibus Principle can be applied to Customary International Law for it is a tacit agreement and since Rebus Sic Stantibus Principle includes all kinds of agreement, it must be applied to justifying Preemptive Self – Defense as well. | en_US |
