| Abstract: | วิทยานิพนธ์เล่มนี้มีวัตถุประสงค์หลัก เพื่อศึกษาการปรับใช้หลัก Essential Facility Doctrine หรือหลักสิ่งอำนวยความสะดวกที่จำเป็น และหลักเกณฑ์ของกฎหมายของประเทศสหรัฐอเมริกา และสหภาพยุโรปที่เกี่ยวข้องกับการเชื่อมต่อโครงข่ายโทรคมนาคมเพื่อเปรียบเทียบ และวิเคราะห์กับกรณีการปรับใช้หลักสิ่งอำนวยความสะดวกที่จำเป็นดังกล่าวในบริบทของการเชื่อมต่อโครงข่ายโทรคมนาคมในประเทศไทย ผลของการวิจัยผู้วิจัยพบการกำกับดูแลเกี่ยวกับการเชื่อมต่อโครงข่ายโทรคมนาคมของประเทศไทยแตกต่างจากหลักการเรื่องสิ่งอำนวยความสะดวกที่จำเป็นของประเทศสหรัฐอเมริกา และสหภาพยุโรป และแตกต่างจากการกำกับดูแลเรื่องการเชื่อมต่อโครงข่ายโทรคมนาคมของประเทศสหรัฐอเมริกา และสหภาพยุโรปด้วย โดยหลักสิ่งอำนวยความสะดวกที่จำเป็น และการกำกับดูแลการใช้ และเชื่อมต่อโครงข่ายโทรคมนาคมของประเทศสหรัฐอเมริกา และสหภาพยุโรปมีลักษณะร่วมกันคือมีการกำหนดหน้าที่ให้แก่ผู้ประกอบการที่มีอำนาจเหนือตลาดมากกว่าผู้ประกอบการทั่วไป อันเป็นลักษณะของการกำกับดูแลแบบ Asymmetric Regulation ในขณะที่การกำกับดูแลเกี่ยวกับการใช้ และเชื่อมต่อโครงข่ายโทรคมนาคมเป็นหน้าที่ของผู้ประกอบการทุกรายทั้งนี้เป็นผลมาจากพัฒนาการและสภาพแวดล้อมของการประกอบการที่ต่างกันและการกำกับดูแลแบบไม่เท่าเทียมกันไม่เหมาะสมกับสภาพการประกอบกิจการโทรคมนาคมของไทยในปัจจุบัน |
| Other Abstract: | The purpose of this thesis is to conduct a comparative study on the Essential Facility Doctrine and the regulation regarding Interconnection under the law of the United States of America (USA) and the law of the European Union (EU) in comparison with the Interconnection regulation under Thai law. Briefly the researcher has realized that the Interconnection regulations under Thai law differ from the Essential Facility Doctrine and the Interconnection regulations of USA and EU. Under the Interconnection regulations of USA and EU, the researcher found that the regulations impose asymmetric obligations to the operators. On the contrary, Thai Interconnection regulations do not impose asymmetric obligation to the operators. From the study, the asymmetric regulation is not suitable for the present situation in the telecommunication market in Thailand. |
