| Abstract: | งานวิจัยนี้ มีวัตถุประสงค์เพื่อศึกษาความเชื่อมโยงของทรัพย์สินทางปัญญากับสุขภาวะ ในบริบทโลกาภิวัตน์อธิบายความสัมพันธ์ระหว่างทรัพย์สินทางปัญญากับหลักประกันสุขภาพถ้วนหน้าในบริบทสังคมแห่งความเสี่ยง ศึกษารูปแบบของความเสี่ยงต่อสุขภาพของผู้ป่วยเอดส์ที่ได้รับผลกระทบจากสิทธิบัตรยา ตลอดจนศึกษากระบวนการปรับตัวและการรับมือผลกระทบของระบบสิทธิบัตรยาในระดับนโยบายและระดับตัวบุคคล ซึ่งแนวคิดที่นำมาใช้ในการวิจัยครั้งนี้ ได้แก่ แนวคิดเกี่ยวกับโลกาภิวัตน์ แนวคิดสังคมแห่งความเสี่ยง แนวคิดเรื่องทรัพย์สินทางปัญญา แนวคิดทฤษฎีนโยบายการสร้างหลักประกันสุขภาพถ้วนหน้า และแนวคิดเรื่องสิทธิของผู้ป่วยเอดส์ งานวิจัยนี้ เป็นการวิจัยเชิงคุณภาพ ซึ่งผู้วิจัยใช้การวิจัยเป็นเชิงคุณภาพเพื่อดูรูปแบบของความสัมพันธ์ในเรื่องของ ทรัพย์สินทางปัญญา หลักประกันสุขภาพถ้วนหน้า และสุขภาวะ โดยมองความเชื่อมโยงใน 2 บริบท คือ บริบทกระบวนการโลกาภิวัตน์ และบริบทของความเสี่ยง เพราะผลกระทบที่เกี่ยวข้องกับเรื่องดังกล่าวข้างต้น สอดคล้องกับวิถีชีวิตประจำวันที่เราประสบ และในการวิจัยครั้งนี้ มีกลุ่มตัวอย่างซึ่งเป็นผู้ให้ข้อมูลคนสำคัญ จำนวน 15 ท่าน ผลการวิจัยพบว่าในบริบทโลกาภิวัตน์ทรัพย์สินทางปัญญามีความเชื่อมโยงกับสุขภาวะอย่างชัดเจนในเรื่องของการเข้าถึงยาและบริการสุขภาพ โดยผ่านระบบการคุ้มครองในเรื่องของสิทธิบัตร ซึ่งผลการศึกษาพบว่าเป็นคุ้มครองเกินกว่าศักยภาพเทคโนโลยีและการพัฒนาประเทศ นอกจากนี้ยังพบว่าในสังคมปัจจุบันที่จัดเป็นสังคมความเสี่ยง ทรัพย์สินทางปัญญามีความสัมพันธ์กับหลักประกันสุขภาพถ้วนหน้า โดยโครงการหลักประกันสุขภาพระดับชาติ ได้รับผลกระทบอย่างหลีกเลี่ยงไม่ได้ เพราะเมื่อพิจารณาในระดับหน่วยย่อย ก็คือ ประชาชนทุกคนที่จำเป็นต้องใช้ยา โดยเฉพาะยาที่มีสิทธิบัตร ทำให้งบประมาณด้านสุขภาพเพิ่มสูงขึ้น ดังนั้นถ้าการเปิดเสรีภาพทางการค้าส่งผลให้ยาราคาสูงอันเนื่องมาจากการคุ้มครองทรัพย์สินทางปัญญาด้วยระบบสิทธิบัตรที่เข้มงวดและนานเกินไป สุขภาพก็จะได้รับผลกระทบ ในสถานการณ์ปัจจุบันที่เป็นอยู่ ผลต่อเนื่องดังกล่าวจึงก่อความเสี่ยงต่อสุขภาพของผู้ป่วยเอดส์ที่จำเป็นต้องเข้าถึงยาต้านไวรัสและบริการสุขภาพอย่างต่อเนื่องทำให้การเข้าถึงวิธีในการรักษาสุขภาพที่จะช่วยให้มีคุณภาพชีวิตทีดียากยิ่งขึ้น |
| Other Abstract: | The purpose of this research is to study the connection between intellectual property and health status in the Globalising Context, to explain the relationship between intellectual property and Universal Health Coverage in a risk prone society, and to study the model of the various risks to the health of People living with HIV/AIDS that has been impacted by Drug patent system. The study will look at the whole process from the plan needed to challenge patent rights, starting at the policy level to the individual level. So, the concepts that will be researched there include globalization, risk society, intellectual property, universal health coverage, and the rights of People living with HIV/AIDS. This research is quality oriented where the researcher sets out to study the relationship in the context of intellectual property, universal health coverage, and health status by examining the connection in 2 areas. The areas are globalization and risk factors, since the impact caused by the items discussed earlier is related to daily life we all face. Also in this research, the sample population of 15 individuals who provided invaluable data led to finding that the globalization of intellectual property category is clearly related to health status in the case of obtaining medicine and general healthcare needs when under protection from the patent system. The results of the study showed that too much protection is given to intellectual property rights considering the level of technology and country development. In addition, it was found that in the current risk prone society intellectual property rights is related to universal healthcare in the case of national health care which was greatly affected. When considered on a small scale, each individual who has a need for medicine, particularly patent protected medicine, will cause the program’s budget to increase at an alarming rate. So if the opening of free trade will cause intellectual property to come under strict patent laws for an unreasonably long period of time causing high costs for medicine, the heath status of individuals will be directly affected. In the situation that we are currently in, the problems mentioned have caused an increase risk to the health of People living with HIV/AIDS that require a constant supply of medicine to fight the virus and health care, making it difficult for them to maintain a healthy lifestyle. |
