| Abstract: | วิเคราะห์สังเคราะห์กฎบัตรสิทธิและหน้าที่นิสิตนักศึกษาต่างประเทศ และระเบียบข้อบังคับนิสิตนักศึกษาไทย พัฒนากฎบัตรสิทธิและหน้าที่นิสิตนักศึกษาไทย จัดทำประมวลสิทธิและหน้าที่นิสิตนักศึกษาไทย พร้อมด้วยกระบวนการพิจารณาทางนิตินัย ที่สอดคล้องกับกฎบัตรสิทธิและหน้าที่นิสิตนักศึกษา และตรวจสอบความเป็นไปได้ในการใช้กฎบัตรสิทธิและหน้าที่นิสิตนักศึกษาไทย ประมวลสิทธิและหน้าที่นิสิตนักศึกษาไทย และกระบวนการพิจารณาทางนิตินัย โดยการวิเคราะห์สาระและการสัมภาษณ์แบบไม่มีโครงสร้างในแนวลึก จากกลุ่มตัวอย่างผู้บริหารระดับสูง ได้แก่รองอธิการบดีฝ่ายวิชาการ รองอธิการบดีฝ่ายกิจการนิสิตนักศึกษา กลุ่มทางกฎหมายได้แก่ นิติกร ตัวแทนอาจารย์คณะนิติศาสตร์ และกลุ่มผู้นำนิสิตนักศึกษา จำนวน 33 คน วิเคราะห์สาระจากการสัมภาษณ์ ตรวจสอบผลการวิจัยโดยการประเมินโดยผู้ทรงคุณวุฒิ 2 รอบ การตรวจสอบโดยนักกฎหมาย และตรวจสอบความเป็นไปได้ในการนำไปใช้จากเว็บไซต์ ผลการวิจัย 1. กฎบัตรสิทธินิสิตนักศึกษา จำแนกตามเนื้อหาของสิทธิและเสรีภาพ ตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2540 เป็น 7 ประเด็น คือ 1) สิทธิและเสรีภาพส่วนบุคคล 2) สิทธิและเสรีภาพในทางความคิดและการแสดงความคิดเห็น 3) สิทธิและเสรีภาพทางสังคม 4) สิทธิและเสรีภาพในการรวมกลุ่ม 5) สิทธิและเสรีภาพทางการเมืองและการปกครองในสถาบัน 6) สิทธิตรวจสอบการทำงานของสถาบัน 7) สิทธิได้รับการปฏิบัติอย่างเท่าเทียมกัน 2.กฎบัตรหน้าที่นิสิตนักศึกษา จำแนกตามเนื้อหาสิทธิ ที่ปรากฏตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2540 เป็น 4 ประเด็น คือ 1) หน้าที่และความรับผิดชอบต่อตนเอง 2) หน้าที่และความรับผิดชอบต่อผู้อื่น 3) หน้าที่และความรับผิดชอบต่อสถาบัน 4) หน้าที่และความรับผิดชอบต่อสังคมและประเทศชาติ 3. ประมวลสิทธิและหน้าที่นิสิตนักศึกษาตามหลักการอุดมศึกษาเกี่ยวกับกฎหมาย ได้แก่ 1) การรับเข้า 2) การให้เกรด หน่วยกิตและปริญญา 3) การจัดทำแฟ้มและการบันทึกแฟ้ม 4) องค์การนิสิตนักศึกษา 5) สิ่งพิมพ์นิสิตนักศึกษา 6) การคัดค้านและการเดินขบวน 7) การให้ทุนสนับสนุน 8) การจัดบริการเสริม 9) หอพัก 10) การกีฬา 11) ความปลอดภัยในสถาบัน 12) ระบบว่าด้วยวินัยและการร้องเรียน 13) กฎระเบียบและข้อบังคับทางวินัย 14) กระบวนการพิจารณาความผิดและบทลงโทษต่างๆ 4. กระบวนการพิจารณาทางนิตินัย จัดจำแนกตามหลักนิติธรรม และหลักทางวินัย 4 ประเด็น คือ 1) สิทธิทั่วไป 2) การกำหนดปัจจัยที่เกี่ยวข้อง 3) หลักการพิจารณา 4) กระบวนการพิจารณา |
| Other Abstract: | To analyse and synthesize student charters form foreign countries and the statutes and regulations of Thai institutions of higher education under the jurisdiction of the Ministry of University Affairs, to develop the charter of Thai student rights and responsibilities, to develop the code of Thai student rights and responsibilities with due process of law, and to conduct feasibility of the outcomes. Research methods employed were content analysis and in-depth unstructured interview with 33 samples consisting of vice-presidents for academic affairs, vice-presidents for student affairs, legal officers, representatives from the Faculties of Law, presidents of students, and the leaders of student organizations.The drafted charter in form of dendrograms was reviewed twice by the group of experts according to the connoissership model. Final comments from students were culminated through a specially designed website. Results of the research 1. Thai student charter of rights was divided by the rights and freedom inaccordance with the content of the Constitution of the Kingdom of Thailand of 1997, as follows 1) Individual rights and freedom, 2) Rights and freedom of thoughts and expressions, 3) Social rights and freedom, 4) Rights and freedom of association, 5) Rights and freedom in policy and institutional governance, 6) Rights in examining the institution{174}s work, 7) Rights in equal treatments. 2. Thai student charter of responsibilities was also divided in accordance with the content of the Constitution of the Kingdom of Thailand of 1997 in 4 topics1) Personal duties and responsibilities, 2) Duties and responsibilities to others, 3) Duties and responsibilities to the institution, 4) Duties and responsibilities to the society and the nation. 3. Code of student rights and responsibilities, according to the legal principles of higher education was categorized as follows 1) Admission, 2) Grades, credits, and degrees, 3) Student files and records, 4) Student organizations, 5) Student press, 6) Student protest and demonstrations, 7) Financial aid, 8) Supporting services, 9) Student housing, 10) Athletics, 11) Campus security, 12) Disciplinary and grievance systems, 13) Disciplinary rules and regulations, 14) Procedures for suspension, dismissal, and other sanctions. 4. Fundamental procedural fairness to accused students derived from the principles of due process model and the principles of student discipline, namely, 1) General rights, 2) Relevant considerations, 3) Principles of the hearing, 4) Hearing process. |
