dc.description.abstractการวิจัยนี้มีวัตถุประสงค์เพื่อทราบรายละเอียดของระบบควบคุมการถ่ายทอดเทคโนโลยีที่มีใช้ในบางประเทศโดยเฉพาะประเทศกำลังพัฒนา รวมทั้งวิธีการส่งเสริมการถ่ายทอดเทคโนโลยี เพื่อเป็นแนวทางสำหรับประเทศไทยหากจะมีระบบเช่นนี้บ้าง ผลการวิจัยพบว่าระบบควบคุมไม่ว่าโดยมาตรการทางกฎหมายหรือมาตรการทางบริหารจะควบคุมในประเด็นค่าตอบแทน, เนื้อหาสัญญาและตัวเทคโนโลยีเอง ปัจจุบันมีกฎหมายไทยเพียงบางฉบับที่เกี่ยวข้องกับการถ่ายทอดเทคโนโลยี บางฉบับมีผลในทางส่งเสริม แต่บางฉบับควบคุมโดยเฉพาะในประเด็นควบคุมการทำสัญญาถ่ายทอดเทคโนโลยี ในต่างประเทศบางประเทศประสบความสำเร็จจากการควบคุมในขณะที่บางประเทศล้มเหลว ประเทศไทยเคยมีความพยายามที่จะออกกฎหมายหรือกฎระเบียบในการควบคุมถึง 2 ครั้งโดยเฉพาะคณะกรรมการส่งเสริมการลงทุน การควบคุมอาจมีทั้งผลดีและผลเสียและภาคเอกชนคงมีข้อคัดค้าน บทบาทที่รัฐควรกระทำไม่ว่าจะโดยออกเป็นกฎหมายเฉพาะหรือวิธีใดนั้นควรเป็นการส่งเสริมอันจะมีความเป็นไปได้มากกว่า ดังนั้นรูปแบบกฎหมายไทยในการถ่ายทอดเทคโนโลยีควรเป็นกฎหมายส่งเสริม โดยเฉพาะการส่งเสริมการวิจัยและพัฒนาโดยมีแนวคิดและรูปแบบดังที่วิเคราะห์ไว้-
dc.description.abstractalternativeThis research was to understand the details of technology transfer control system being used in certain countries, especially in developing countries including the promotion of technology transfer which will be used as a guidance in Thailand if it want to have such system. It was found that the system controls over the compensation issue, terms of contract and technology itself. Many countries are successful in establishing the system but some are failure in doing so. There have been twice attempts by the Board of Investment of Thailand to enact law or regulation to control technology transfer. At present, there are some Thai laws relevant to technology transfer. Some have an effect in promoting the transfer and some in control, especially in the execution of technology transfer contracts. In Thailand this system may produce a good or bad effect. The private sectors, however, still have some objection on such establishment as well. The Thai government’s role, no matter by means of enacting a specific law or otherwise should be technology transfer promotion. Therefore, the form of Thai technology transfer law should be in term of promoting laws, in particular in R&D promotion.-
