dc.description.abstract	การศึกษาครั้งนี้มีวัตถุประสงค์ เพื่อกำหนดมาตรการในการเตรียมความพร้อมของประเทศไทยในการเข้า เป็นภาคีพิธีสารมาดริด และเสนอแนะแนวทางในการแก้ไขปัญหาการจดทะเบียนเครื่องหมายการค้าใน ต่างประเทศของผู้ประกอบธุรกิจส่งออกชาวไทย ผู้ประกอบวิชาชีพกฎหมายชาวไทยโดยผลการศึกษา พบว่า 1) การเข้าเป็นภาคีสมาชิกพิธีสารมาดริด จะสามารถแก้ไขปัญหาการละเมิดเครื่องหมายการค้า ของไทยในต่างประเทศ กล่าวคือ ผู้ประกอบการส่งออกชาวไทยจะสามารถจดทะเบียนเครื่องหมาย การค้าในต่างประเทศได้สะดวกขึ้น โดยยื่นคำขอจดทะเบียนเครื่องหมายการค้าระหว่างประเทศเพียงคำ ขอเดียว แต่ได้รับความคุ้มครองในหลายประเทศ ประหยัดเวลามากขึ้น เพราะประเทศภาคีสมาชิก จะต้องพิจารณาคำขอจดทะเบียนเครื่องหมายการค้าให้แล้วเสร็จภายใน 12 หรือ 18 เดือน และประหยัด งบประมาณในการจดทะเบียน เพราะไม่ต้องดำเนินการยื่นคำขอจดทะเบียนแบบรายประเทศ ซึ่งต้อง เสียค่าจ้างที่ปรึกษากฎหมายหรือตัวแทนจดทะเบียนเครื่องหมายการค้าในทุกประเทศที่ตนยื่นคำขอจด ทะเบียน และเสียค่าจ้างในการแปลเอกสารที่เกี่ยวข้องในทุกๆ ประเทศ 2) การเข้าเป็นภาคีสมาชิก พิธีสารมาดริดจะอำนวยประโยชน์อย่างเต็มที่ได้ ก็ต่อเมื่อมีมาตรการในการเตรียมความพร้อมที่มี ประสิทธิภาพ ในส่วนมาตรการด้านกฎหมายนั้น ประเทศไทยจะต้องเข้าเป็นภาคีสมาชิกอนุสัญญากรุงปารีส นอกจากนี้จะต้องมีการแก้ไข พระราชบัญญัติเครื่องหมายการค้า และควรมีการออกข้อบังคับเกี่ยวกับ การจดทะเบียนเครื่องหมายการค้าระหว่างประเทศ เพื่อ อนุวัตรการให้เป็นไปตามพิธีสารมาดริด, ในส่วนมาตรการด้านอื่นๆนั้น รัฐควรให้ความสำคัญในการเตรียมความพร้อม ในการเข้าเป็นภาคีสมาชิก พิธีสารมาดริด, กรมทรัพย์สินทางปัญญาและบุคลากรต้องศึกษาระบบการจดทะเบียนระหว่างประเทศให้ดี, ผู้ประกอบการส่งออกและผู้ประกอบวิชาชีพกฎหมายชาวไทยจะต้องปรับตัวกับระบบการจดทะเบียน เครื่องหมายการค้าระหว่างประเทศภายใต้พิธีสารมาดริด	en
dc.description.abstractalternative	The purpose of this thesis was to determine the legal measures in preparation for the accession of Thailand to the Madrid protocol and recommend methods to solve Thai exporter{7f2019}s trademark infringement problems in abroad. The results were as follows ; 1. International registration of marks under Madrid protocol can solve Thai trademarks infringement problems in abroad because trademark registration in abroad can do easier. The owner of the trademarks file only one request to register international trademark but will be protected in many countries. Moreover, it will save budget and time in registration procedure. 2. In order to get the most benefit from accession to the Madrid Protocol, Thailand must have legal measures preparing, must access Paris Convention, amend Trademark Act and international registration of marks rule should be enacted. Government should recognize in preparation for the accession and department of intellectual property must learn international registration of marks system under Madrid protocol. Finally, Thai exporter and lawyer should understand international registration of marks procedure clearly.	en
