dc.description.abstract	ปัจจุบันอาชญากรรมทางคอมพิวเตอร์ที่มีลักษณะข้ามประเทศเกิดขึ้นมากมายประเทศต่างๆจึงได้ทำความตกลงระหว่างประเทศเพื่อป้องกันและปราบปรามอาชญากรรมคอมพิวเตอร์ในระดับสากล คือ อนุสัญญาของสภายุโรปว่าด้วยอาชญากรรมทางคอมพิวเตอร์ ค.ศ. 2001 ซึ่งเป็นอนุสัญญาที่มีการกำหนดมาตรการทางด้านกฎหมายสบัญญัติ กฎหมาย สารบัญญัติ ความร่วมมือระหว่างประเทศ การจัดตั้งองค์กรที่มีเครือข่าย 24 ชั่วโมง การระงับข้อพิพาท เพื่อให้สามารถนำตัวผู้กระทำความผิดเกี่ยวกับอาชญากรรมทางคอมพิวเตอร์ข้ามประเทศมาลงโทษได้อย่างรวดเร็วและมีประสิทธิภาพประเทศไทยประสบปัญหาอาชญากรรมทางคอมพิวเตอร์เช่นกัน และได้มีการกำหนดความผิดเกี่ยวกับอาชญากรรมทางคอมพิวเตอร์ไว้ในพระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2550 แล้วแต่การแสวงหากรอบความร่วมมือระหว่างประเทศที่เอื้อประโยชน์ต่อการป้องกันและปราบปรามอาชญากรรมทางคอมพิวเตอร์ที่มีลักษณะข้ามประเทศนั้นเป็นสิ่งจำเป็น โดยหากพิจารณาเข้าเป็นภาคีอนุสัญญาดังกล่าวจะทำให้ประเทศไทยได้รับประโยชน์จากการสืบสวนสอบสวนอาชญากรรมทางคอมพิวเตอร์แบบข้ามพรมแดนและได้รับความร่วมมือระหว่างประเทศ ได้แก่ การส่งตัวผู้ร้ายข้ามแดน ทั้งนี้ประเทศไทยต้องมีการแก้ไขเพิ่มเติมกฎหมายเกี่ยวกับการคุ้มครองข้อมูลส่วนบุคคลเกี่ยวกับการถ่ายโอนข้อมูลข้ามประเทศ อย่างไรก็ตามในอนาคตเมื่อประเทศไทยมีความพร้อมประเทศไทยอาจทบทวนเพื่อเข้าร่วมเป็นภาคีอนุสัญญานี้ได้	en_US
dc.description.abstractalternative	Nowadays Transitional Cyber Crime has been expanded in several nations. Therefore, many nations joined hands to form an international treaty, called The Council of Europe's Convention on Cyber Crime 2001, to prevent and protect society against cyber crime. The Convention contains a provision on substantive law, procedural law, an international co-operation, an organization which has network available for twenty-four hours a day, as well as, settlement of dispute, in order to be able to punish the offender against Transitional Cyber Crime immediately and effectively Thailand has also experienced with the computer crime. In 2007 we have legislation on Computer Crime Act B.E 2550 (2007). However, a cooperation between other countries and Thailand should also be considered. If Thailand ratified the convention, we will gain benefit on transitional cyber crime investigation and receive well cooperation from other countries, including extradition. Thailand yet need to amend its law concerning the personal information transferring protection. In the future, when Thailand gains more experience, we can reconsider whether we would like to join in the treaty.	en_US
