dc.description.abstract	ศึกษาและวิเคราะห์มาตรการ กระบวนการ ระดับและวิธีการของการมีส่วนร่วมของประชาชน ในการจัดการทรัพยากรประมงของประเทศไทย ผลการศึกษาวิจัยพบว่า มาตรการทางกฎหมายที่ใช้ในการจัดการทรัพยากรประมงในปัจจุบัน ตามพระราชบัญญัติการประมง พ.ศ. 2490 และกฎหมายอื่นๆ ที่เกี่ยวข้อง เป็นอำนาจหน้าที่ของหน่วยงานต่างๆ ของรัฐจัดการแต่เพียงฝ่ายเดียว ไม่เปิดโอกาสให้ประชาชนเข้ามามีส่วนร่วมในการจัดการเท่าที่ควร ส่งผลให้เกิดความเสื่อมโทรมและความขัดแย้งในการใช้ประโยชน์จากทรัพยากรประมง ตลอดจนบทบัญญัติแห่งกฎหมายดังกล่าวยังไม่มีความสอดคล้อง กับรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2540 ที่บัญญัติรับรองสิทธิของประชาชนและชุมชนท้องถิ่น ในการมีส่วนร่วมจัดการทรัพยากรธรรมชาติร่วมกับภาครัฐ จากสภาพปัญหาดังกล่าว ผู้วิจัยจึงได้เสนอแนะให้มีการปรับปรุงแก้ไขบทบัญญัติ ของพระราชบัญญัติการประมง พ.ศ. 2490 ซึ่งเป็นกฎหมายที่เกี่ยวข้องกับการจัดการทรัพยากรประมงโดยตรง เนื่องจากกฎหมายดังกล่าวยังมีข้อบกพร่องและมีความล้าสมัย ไม่เหมาะสมกับสถานะการณ์ปัจจุบันหลายประการ โดยเฉพาะอย่างยิ่งบทบัญญัติในส่วนของการรับรองสิทธิของประชาชน ในการมีส่วนร่วมจัดการทรัพยากรประมง โดยนำเสนอให้มีการกำหนดรูปแบบองค์กรการมีส่วนร่วมของประชาชน ตลอดจนแนวทางการมีส่วนร่วมในแต่ละระดับ ให้มีความเหมาะสม ชัดเจนและเพียงพอ อีกทั้งแนวทางการบังคับใช้กฎหมายขององค์กรภาครัฐ ให้มีความชัดเจนและเป็นไปในทิศทางเดียวกัน อันจะเป็นอีกแนวทางหนึ่งที่จะส่งผลให้ การจัดการทรัพยากรประมงของประเทศไทยเกิดประสิทธิภาพ และเป็นไปตามเจตนารมณ์ของรัฐธรรมนูญฉบับปัจจุบัน	en
dc.description.abstractalternative	To study and analyze a measure, process, level, and method relevant to public participation in fisheries management in Thailand. The research finding reveals that present legal measures taken for the management of fisheries pursuant to the Fisheries Act, B.E. 2490 (1947) and other laws purely fall under the powers and duties of state agencies. No sufficient opportunity is provided for public to participate in the said management. This results in degeneration of and conflict in exploitation of fisheries. In addition, those laws are inconsistent with the provisions of the Constitution of the Kingdom of Thailand, B.E. 2540 (1997) which guarantee the right of people and a local community to co-participate in fisheries management with the State. Based on those problems, the researcher recommends the revision of the Fisheries Act, B.E. 2490 (1947) which is the law dealing directly with the fisheries management of the country. This is because the said law contains provisions which are flawed and unfit for present situations, especially those guaranteeing people's right to participate in fisheries management. As for the revision, it is suggested that a form of public participation body should be established. Rules for public participation in each level should be set up to be appropriate, unambiguous, and sufficient. Furthermore, measures for law enforcement by public bodies should be clearly and uniformly stipulated as being a way to achieve that the fisheries management in Thailand be effective and be in accordance with the spirit of the present Constitution.	en
