dc.description.abstract	วิทยานิพนธ์นี้มีจุดมุ่งหมายที่จะศึกษาสภาพปัญหาที่เกิดขึ้นขึ้นในระหว่างการดำเนินงานตามอำนาจหน้าที่ของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ โดยศึกษาถึงอำนาจหน้าที่ขององค์กรที่มีหน้าที่คล้ายคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติในต่างประเทศ เพื่อนำมาเป็นแนวทางในการปรับปรุงการดำเนินงานของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ ผลการศึกษาพบว่าสภาพปัญหาที่เกิดขึ้นในระหว่างการดำเนินงานตามอำนาจหน้าที่ของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาตินั้น ปัญหาสำคัญประการแรกคือข้อจำกัดในด้านทรัพยากรบุคคลที่ไม่สามารถรองรับเรื่องเรียนจำนวนมากได้จนส่งผลให้การดำเนินงานล่าช้าเนิ่นนาน ประการต่อมาคืออำนาจหน้าที่ตามกฎหมายของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติมีอยู่มากมายจนทำให้มีเรื่องเข้าสู่การพิจารณาของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติเป็นจำนวนมาก และประการสุดท้ายคือหลักการตามบทบัญญัติของกฎหมายที่กำหนดให้คณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติดำเนินการเป็นหลักการใหม่ ส่วนใหญ่ยังไม่มีแนวทางปฏิบัติที่ลงตัว รวมทั้งบางเรื่องยังไม่มีกฎหมายที่เกี่ยวข้องรองรับ เช่น การจัดการหุ้นส่วนและหุ้นของรัฐมนตรี เป็นต้น ดังนั้น เมื่อศึกษาถึงอำนาจหน้าที่ขององค์กรที่มีหน้าที่คล้ายคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติในต่างประเทศแล้วผลปรากฏว่าปัญหาเรื่องข้อจำกัดด้านทรัพยากรบุคคลสามารถแก้ไขได้โดยการเพิ่มจำนวนบุคคลให้พอเพียงต่อปัญหาที่เกิดขึ้นดังเช่น ICAC ฮ่องกงหรือนำแนวทางการเปรียบเทียบว่าเรื่องร้องเรียนมีหน่วยงานอื่นๆ รับผิดชอบได้ดีกว่าหรือความสอดคล้องของเรื่องร้องเรียนกับจุดมุ่งหมายหลักของ ICAC รัฐนิวเซาท์เวลส์อันทำให้ต้องเป็นผู้ดำเนินการสอบสวนเองส่วนปัญหาประการสุดท้ายคงต้องอาศัยระยะเวลาในการปฏิบัติงานและการศึกษาค้นคว้าข้อมูลเปรียบเทียบเพื่อหาแนวทางที่เหมาะสมต่อการปฏิบัติงานในอนาคตต่อไป	en
dc.description.abstractalternative	The purpose of this thesis is to examine the problems which have been occurred during the work performance, in accordance with the authority of the National Counter Corruption Commission (NCCC). The examination will study the power of foreign organizations which have similar authority as NCCC in order to apply to its work performance. As a result, the study has found that, according to the authority of NCCC, the first important problem is the limitation of manpower, which cannot be able to serve the large amount of complaints. This, however, caused the delay in its work. The second problem is multifarious legal authority of NCCC that seem like every corruption path bound to NCCC. The last one is the principle in accordance with the provision of law which states that NCCC should implement the new rules. However, most of which has no divisible way of practices. In addition, some matters have no related laws to support for example share management and share of the Minister etc. In this connection, when study the foreign organizations which have similar authority as NCCC, the study result shown that the limitation of manpower can be solved by increasing the efficient number of staff like ICAC of Hong Kong. On the other hand, the comparison of which organization can handle the complaits better than NCCC should be considered. Morever, the complaint and the main purpose of the organization should be in the same path for example ICAC of New South Wale who has to take part in investigation by themselves. The last problem, as mentioned before, need to have a period of time in implementing and study so that the appropriate way of practice shall be found in the future.	en
