dc.description.abstract	การวิจัยเรื่องนี้มีจุดมุ่งหมาย เพื่อศึกษาถึงมาตรการทางกฎหมายที่ใช้บังคับในการป้องกันและลดผลกระทบสิ่งแวดล้อมจากการทำเหมือง จากการศึกษาพบว่า การทำเหมืองย่อมกระทบต่อทรัพยากรธรรมชาติประเภทอื่นที่มีอยู่ร่วมกันอย่างหลีกเลี่ยงไม่ได้ ผลกระทบที่เกิดขึ้นมีตั้งแต่ผลกระทบต่อป่าไม้ การดำรงชีพของสัตว์ป่าแหล่งน้ำธรรมชาติ ดิน รวมทั้งความปลอดภัยและสุขภาพอนามัย ปัญหาผลกระทบจากการทำเหมืองดังกล่าวจะต้องดำเนินการป้องกันและแก้ไขให้เป็นไปอย่างมีประสิทธิภาพโดยใช้กฎหมายเป็นมาตรการในการป้องกันและแก้ไขปัญหาผลกระทบจากการทำเหมือง การวิจัยเรื่องนี้จึงได้เสนอให้มีการปรับปรุงแก้ไขบทบัญญัติของกฎหมาย โดยควรกำหนดให้มีการผนวกแผนผังโครงการทำเหมืองและรายงานการวิเคราะห์ผลกระทบสิ่งแวดล้อมเข้าด้วยกันเป็นแผนแม่บทการทำเหมืองและการจัดการด้านสิ่งแวดล้อม กำหนดให้การปรับสภาพพื้นที่ที่ผ่านการทำเหมืองควรรวมไปถึงการจัดทำแผนงานในการฟื้นฟูและจัดการด้านสิ่งแวดล้อมเป็นระยะๆ เพื่อความชัดเจนในทางปฏิบัติ ยกเลิกอำนาจของรัฐมนตรีว่าการกระทรวงอุตสาหกรรมที่อนุญาตให้ปล่อยน้ำขุ่นข้นหรือมูลดินทรายลงทางน้ำสาธารณะบางแห่งได้ กำหนดให้ผู้ถือประทานบัตรซึ่งกระทำหรือละเว้นการกระทำการใดอันเป็นเหตุให้แร่ที่มีพิษหรือสิ่งอื่นที่มีพิษก่อให้เกิดอันตรายแก่บุคคล สัตว์ พืช หรือทรัพย์สิน จะต้องรับผิดชดใช้ค่าเสียหายตามความเป็นจริง โดยมีการทำสัญญาวางเงินประกันในกรณีดังกล่าวด้วยกำหนดภาระการพิสูจน์เกี่ยวกับความเสียหายที่เกิดขึ้นในพื้นที่และนอกพื้นที่เขตเหมืองแร่ กำหนดให้มีโทษทางอาญาสำหรับการฝ่าฝืนคำสั่งของเจ้าพนักงานควบคุมมลพิษที่สั่งให้เจ้าของหรือผู้ครอบครองแหล่งกำเนิดมลพิษแก้ไขหรือปรับปรุงให้เป็นไปตามมาตรฐาน กำหนดให้มีการยกเว้นไม่ทำรายงานการวิเคราะห์ผลกระทบสิ่งแวดล้อมสำหรับเหมืองแร่ขนาดเล็กที่ไม่มีแร่เป็นพิษเจือปน การจัดทำรายงานการวิเคราะห์ผลกระทบสิ่งแวดล้อมเบื้องต้นแทนการจัดทำรายงานการวิเคราะห์ผลกระทบสิ่งแวดล้อมเต็มรูปแบบสำหรับบางโครงการ สำหรับมาตรการการจัดการควบคุมดูแลนั้น กรมทรัพยากรธรณีควรมีมาตรการการจัดการให้ผู้ขอประทานบัตรทำการสำรวจแร่ให้เป็นไปอย่างจริงจัง ควรพิจารณายกเว้นหรือลดภาษีสำหรับเครื่องมือ หรืออุปกรณ์รวมทั้งค่าใช้จ่ายที่ผู้ประกอบกิจการเหมืองแร่ได้จัดหามาเพื่อใช้ในการกำจัดมลพิษ ควรกำหนดให้ประชาชน องค์การบริหารส่วนตำบลและหน่วยงานที่เกี่ยวข้องในพื้นที่ ได้มีส่วนร่วมในการรับทราบและแสดงความคิดเห็นก่อนที่จะมีการดำเนินการโครงการเหมืองแร่	en
dc.description.abstractalternative	The objective of this research is to study legal measures which provide environmental protection and reduction of impacts on environment related to and caused by mining activities. The study reveals that impacts on other natural resources created by mining activities are inevitable. They include forestry, wildlife survival, natural water resources, soil, as well as safety and health. Environmental impact problems created by mining activities must be efficiently dealt with by protective and preventive legal measures. It is thus proposed by this study that relevant legal measures be amended. It should be provided that mining project schedule and environmental impact assessment report be merged as mining and environmental management master plan. Reconditioning of the mined area should include the preparation of environmental rehabilitation and management plan in various stages for easy implementation. The Authority of Minister of Industry permitting discharge of muddy water or sludge into certain public waterways should be repealed. The concessionaire who, by his act or omission thereof, causes harm to any person, animal, plant or property by hazardous ore or other substances, shall be liable to pay compensation for actual damage in which case a guarantee deposit should be required. Burden of proof for damage within and without the mine area should be imposed. Criminal penalty should be provided for the violation of the order of pollution control officer requiring the owner the person in possession of pollution point source to rectify or improve it in accordance with the required standards. The preparation of environmental impact assessment report for small size mine containing no hazardous ore should be exempted. For certain projects, the preparation of preliminary environmental impact assessment report should be required instead of the preparation of full environmental impact assessment report. With regard to the control and oversight measures, the Department of Mineral Resources should see to it that ore exploration be carried out seriously by the concessionaires and that tax or import duty be exempted or reduced for tools or equipment acquired for eliminationof pollution by miner as well as their expenses for such purpose. It is also proposed that the people, the local tambol administration, and all concerned agencies in the area be entitled to the information and expression of their opinion prior to the implementation of mining project.	en
