dc.description.abstract	ระบบประกันสุขภาพ เกิดขึ้นเพื่อเป็นหลักประกันให้แก่ประชาชนว่า เมื่อเกิดความเจ็บป่วย จะได้รับการดูแลรักษาโดยปราศจากอุปสรรคทางการเงิน แต่ในปัจจุบัน พบว่า การกระทำความผิดทางอาญาเกี่ยวกับระบบประกันสุขภาพมีมากขึ้นเรื่อยๆ และความผิดดังกล่าว สร้างความเสียหายต่อระบบเศรษฐกิจ และความน่าเชื่อถือของระบบประกันสุขภาพทั้งภาครัฐ และภาคเอกชน นอกจากนั้น การกระทำความผิดดังกล่าวยังอาจส่งผลกระทบต่อชีวิต และร่างกายของผู้มีสิทธิในระบบประกันสุขภาพที่เข้ารับบริการได้ ผู้กระทำความผิดในกรณีดังกล่าว อาจเป็นบุคลากรทางการแพทย์ สถานพยาบาล ผู้มีสิทธิ หรืออาจจะเป็นบุคคลภายนอกก็ได้ ประเทศไทยยังไม่มีกฎหมายเฉพาะที่จะนำมาใช้บังคับกับการกระทำความผิดอาญาที่เกี่ยวกับระบบประกันสุขภาพ หากเกิดการกระทำดังกล่าวขึ้น จึงจำต้องนำบทบัญญัติในประมวลกฎหมายอาญา และกฎหมายอื่นๆซึ่งเกี่ยวข้อง ที่ใช้อยู่ในปัจจุบันมาบังคับใช้กับการกระทำความผิดในรูปแบบต่างๆ จากการศึกษาพบว่า กฎหมายดังกล่าวมีข้อจำกัดด้านองค์ประกอบความผิด ทำให้ไม่สามารถบังคับใช้กับความผิดเกี่ยวกับระบบประกันสุขภาพในบางรูปแบบ หรือหากบังคับใช้ได้แต่โทษก็ไม่เหมาะสมเหมือนดังประเทศสหรัฐอเมริกา จึงเห็นว่า ประเทศไทยควรมีบทบัญญัติเฉพาะแก่การกระทำความผิดอาญาเกี่ยวกับระบบประกันสุขภาพ ที่ครอบคลุมการกระทำความผิดดังกล่าวในทุกรูปแบบ และมีโทษที่เหมาะสมไว้ในประมวลกฎหมายอาญา เพื่อให้การบังคับใช้กฎหมายเกี่ยวกับเรื่องนี้มีประสิทธิภาพ อันเป็นการป้องกันปราบปรามความผิดอาญาเกี่ยวกับระบบประกันสุขภาพให้น้อยลงได้	en
dc.description.abstractalternative	The healthcare system is created to insure the citizens of that country that when they get sick, they will be treated without money difficulty. Nowadays, crime against healthcare system has been increasingly committed. It causes severe damages to the country's economy and particularly to the health service system both by public and private sectors. Moreover, it directly affected the livelihood of those insured. Besides, the offenders to this crime can be medical professional, healthcare provider, insured and others. In Thailand, there is no particular criminal law against offenses relating to healthcare system. Only few items of the current penal code and some other laws relating to such action maybe considered applicable when such offenses take place. The study shows that the existing laws have limited application for the offence. Certain forms of crime against healthcare system or their punishments are not suitable to the Thai situation. Unlike the laws in the United States where there are more specific provisions in the criminal law of every state. Accordingly, Thailand should initiate the enactment of specific criminal provisions to combat crime against healthcare system. Such enactment should cover the whole range of offences and determine suitable punishment and should be added to the existing penal code. This can make the enforcement of law concerning this matter more efficient and thereby reduce crime against healthcare system.	en
