dc.description.abstract	วิทยานิพนธ์ฉบับนี้ศึกษาการคุ้มครองสิทธิเด็กผู้เสียหายทางเพศภายใต้กระบวนการยุติธรรมในประเทศลาวโดยศึกษาถึงสภาพปัญหา และข้อบกพร่องของกระบวนการยุติธรรมทางอาญาตั้งแต่ขั้นตอนของการสืบสวนสอบสวนของเจ้าหน้าที่ตำรวจ ของอัยการ และขั้นการพิจารณาคดีของศาลเกี่ยวกับความผิดทางเพศที่มีผู้เสียหายเป็นเด็ก เพื่อค้นหามาตรการที่เหมาะสมในการปฏิบัติต่อเด็กผู้เสียหายในคดีความผิดทางเพศให้ดียิ่งขึ้นกว่าปัจจุบันที่มีอยู่ กฎหมายที่มีอยู่ในประเทศลาวปัจจุบันยังไม่ให้การคุ้มครองเด็กผู้ตกเป็นผู้เสียหายเท่าที่ควร ซึ่งกระบวนยุติธรรมลืมคำนึงถึงสภาพร่างกาย และจิตใจที่ได้รับความบอบช้ำมากของเด็กที่ตกเป็นเหยื่อของอาชญากรรมทางเพศ ดังนั้นผู้เขียนจึงดำเนินการศึกษาวิจัย เพื่อหามาตรการที่เหมาะสมเป็นพิเศษสำหรับผู้เสียหายที่เป็นเด็กในคดีความผิดทางเพศในประเทศลาว และได้ศึกษาเปรียบเทียบกับกระบวนการยุติธรรมทางอาญาของต่างประเทศโดยเฉพาะประเทศไทย อเมริกา อังกฤษ ซึ่งถือได้ว่าเป็นกระบวนการยุติธรรมที่พัฒนามาเป็นระยะเวลานาน เพื่อนำมาใช้เป็นแนวทางในการค้นหา และกำหนดมาตรการที่เหมาะสม เพื่อให้กระบวนการยุติธรรมในประเทศลาวสามารถช่วยปกป้องคุ้มครองสิทธิเด็กผู้เสียหาย โดยเฉพาะเด็กที่ตกเป็นเหยื่อของอาชญากรรมทางเพศ ให้ได้รับความยุติธรรมที่สะดวก รวดเร็ว ปลอดภัย และมีประสิทธิภาพยิ่งกว่าที่ได้รับอยู่ในปัจจุบัน และนอกจากนี้ยังทำให้กระบวนการยุติธรรมของประเทศลาวสอดคล้องกับมาตรฐาน และข้อกำหนดตามอนุสัญญาว่าด้วยสิทธิเด็ก วิทยานิพนธ์ฉบับนี้ จึงเสนอให้มีการปรับปรุงกฎหมายวิธีพิจารณาความอาญาในส่วนที่เกี่ยวกับวิธีการการสอบคำให้การในชั้นเจ้าหน้าที่ตำรวจ พนักงานอัยการ และวิธีพิจารณาในชั้นศาลให้เหมาะสมมากขึ้น	en
dc.description.abstractalternative	This thesis studies procedural protection of child’s right against sexual offense in Lao P.D.R. The thesis undertook the study of the nature of problems, and deficiency of the criminal process right from the first step of police investigation, instituting charge by public prosecutor and court hearing and rendering judgments pertaining to sexual offense where child victims are involved. The research seeks better measures that are appropriate for child victims as current laws do not provide appropriate protection for the injured parties. It is regrettable to notice that the criminal justice system neglects the physical and mental suffering of the children who had undergone sexual abuse. Thus the research was conducted to find measures that are appropriate and designed especially for injured person who is a child. Comparative studies of criminal justice processes in Thailand, the US, and the UK pertaining to the safeguard are made with the hope that their measures can be adopted by the Laotian criminal justice system which can help to protect the right of the injured child. Especially, the system should protect a child who becomes a victim of sexual crime so he or she will receive more considerations on convenient justice, speedy, safety and effectiveness of the process. Besides, Lao P.D.R as the party to Child’s Right Convention should develop the process of trial court to correspond with international regulations and accepted standard. This thesis recommend revisions of the law of criminal procedure of Lao PDR to reflect the proper implementation of law during the police investigating process, public prosecutor’s practice and the court’s hearing process.	en
