dc.description.abstract	อนุสัญญาสหประชาชาติว่าด้วยการต่อต้านการทุจริต เป็นเครื่องมือทางกฎหมายฉบับแรกที่ผูกพันให้รัฐภาคีต้องดำเนินการในการต่อต้านการทุจริต โดยได้รับการยอมรับ (adopted) ในการประชุมสมัชชาใหญ่สหประชาชาติ General Assembly ที่ได้มีมติที่ 58/4 เมื่อวันที่ 30 ตุลาคม ค.ศ. 2003 และมีผลบังคับใช้เมื่อวันที่ 14 ธันวาคม ค.ศ. 2005 ปัจจุบันมีรัฐภาคีทั้งสิ้นรวม 151 ประเทศ โดยอนุสัญญาฯ นี้มีวัตถุประสงค์หลักในการส่งเสริมในการสร้างความเข้มแข็งของมาตรการในการป้องกันและปราบปรามการทุจริตให้มีประสิทธิภาพ รวมถึงการให้ความช่วยเหลือระหว่างประเทศ การให้ความช่วยเหลือทางด้านวิชาการ การป้องกันการทุจริต การติดตามทรัพย์สินคืน การสร้างเสริมระบบคุณธรรม จริยธรรม การบริหารจัดการทรัพย์สินที่ดีของภาครัฐ ซึ่งประเทศไทยเข้าเป็นรัฐภาคีอนุสัญญาสหประชาชาติว่าด้วยการต่อต้านการทุจริต ค.ศ. 2003 เมื่อวันที่ 31 มีนาคม พ.ศ. 2554 เรื่องการติดตามทรัพย์สินคืน คือ มาตรการในการริบทรัพย์สินระหว่างประเทศ ซึ่งถือว่าเป็นหมวดที่มีความสำคัญที่สุดของอนุสัญญานี้เนื่องจากการทุจริตมักมุ่งประสงค์ที่ตัวทรัพย์ การลงโทษผู้กระทำความผิด เป็นเพียงส่วนหนึ่ง แต่การติดตามทรัพย์สินกลับคืนยังคงเป็นเรื่องที่ท้าทายต่อนานาประเทศ โดยเฉพาะในส่วนของประเทศไทยการปรับปรุงแก้ไขกฎหมายให้สอดคล้องรองรับตามพันธกรณียังไม่เพียงพอ รวมถึงยังไม่มีประสิทธิภาพในทางปฏิบัติเท่าที่ควร ซึ่งในอนาคตควรมีการปรับปรุงแก้ไขให้สามารถดำเนินการป้องกันการยักย้าย ถ่ายเท ซุกซ่อน ทรัพย์สิน เพื่อการริบและติดตามทรัพย์สินกลับคืนทั้งในและต่างประเทศได้ดีกว่านี้	en
dc.description.abstractalternative	United Nations Convention against Corruption is the first International legal instrument binding state parties in the fight against corruption. This convention was adopted by the General Assembly no. 58/4 in October 30th 2003, and came into force by December 14th 2005. Currently there are 151 state parties to the convention. The convention main purposes are to strengthen state parties measures in prevent and combat corruption more effectively, as well as asset recovery, technical assistance, rule of law, integrity, accountability and proper management of public affairs and public property. In this regard, Thailand has become a state party to the convention by March 30th 2011. The recovery of asset is the fundamental part of this convention. Because corruption is an economic crime where the area of asset recovery is very much challenging to all countries. As Thailand is in the stage of law amending process, where draft laws are still unable to fully comply and implement. Therefore, Thailand must further improve these laws in order to fight transnational corruption and fulfill it’s mandatory obligations in confiscation of asset more effectively.	en
