dc.description.abstract	วิทยานิพนธ์เรื่องนี้เขียนขึ้นจากปัญหาที่เกิดขึ้นจริงจากการบริหารงานของธนาคารพาณิชย์ จากปัญหาที่ธนาคารพาณิชย์ได้ยกขึ้นปรึกษาหารือกับธนาคารแห่งประเทศไทย และจากปัญหาที่ผู้เขียนเองคาดว่าอาจจะเกิดขึ้นในการบริหารงานภายใต้พระราชบัญญัติการธนาคารพาณิชย์ พ.ศ. 2505 โดนอาศัยกฎหมายต่าง ๆ ที่เกี่ยวข้อง เอกสารต่าง ๆ อันเกี่ยวกับธนาคารพาณิชย์ และประสบการณ์ของพนักงานธนาคารพาณิชย์และผู้ตรวจการธนาคารพาณิชย์บางท่าน วิทยานิพนธ์เรื่องนี้ได้อธิบายถึงการบริหารงานตามหลักเกณฑ์ของกฎหมายและวิธีการที่ดี ความยากลำบากของธนาคารพาณิชย์ในการปฏิบัติตามกฎหมาย และชี้ให้เห็นช่องว่างของกฎหมาย ทั้งนี้ก็เพื่อต้องการแสดงทัศนะในทุกด้านอย่างตรงไปตรงมา มิได้มีความประสงค์จะให้ธนาคารพาณิชย์อาศัยช่องว่างของกฎหมายดำเนินการในทางที่ไม่เหมาะสม ซึ่งอาจถูกลงโทษตามกฎหมาย หรือถูกใช้มาตรการลงโทษทางอ้อมได้ จากการศึกษาวิจัยปัญหาในเรื่องนี้ เห็นว่า พระราชบัญญัติการธนาคารพาณิชย์ พ.ศ.2505 มีช่องว่างหลายแห่ง และมีข้อกำหนดบางอย่างที่ก่อให้เกิดปัญหาแก่ธนาคารพาณิชย์ จึงเห็นควรที่กระทรวงการคลังและธนาคารแห่งประเทศไทยจะได้พิจารณาปรับปรุงแก้ไขกฎหมายฉบับนี้ และตรากฎหมายใหม่ออกมาใช้บังคับแทน และเพื่อให้การบริหารงานธนาคารพาณิชย์เป็นไปตามนโยบายของทางราชการและเจตนารมณ์ของกฎหมาย ควรจะได้บัญญัติกฎหมายในลักษณะที่สามารถยืดหยุ่นได้ให้มากที่สุด และให้อำนาจกระทรวงการคลัง ธนาคารแห่งประเทศไทย และผู้ตรวจการธนาคารพาณิชย์เพิ่มขึ้นตามความเหมาะสม ผู้เขียนได้เขียนวิทยานิพนธ์เรื่องนี้ในฐานะนิสิตคนหนึ่งที่ต้องการแสดงความคิดเห็นโดยเสรี มิใช่ในฐานะพนักงานของฝ่ายกำกับและตรวจสอบสถาบันการเงิน ธนาคารแห่งประเทศไทย ความคิดเห็นต่าง ๆ ที่ปรกกฎในวิทยานิพนธ์เรื่องนี้เป็นของผู้เขียนโดยส่วนตัว มิได้เกี่ยวข้องกับส่วนงานดังกล่าว และไม่จำเป็นที่ฝ่ายกำกับและตรวจสอบสถาบันการเงินจะต้องเห็นด้วยทุกกรณี
dc.description.abstractalternative	This thesis is based on problems arisen from commercial banks’ performances; which have been discussed by commercial banks with the Bank of Thailand. It is also based on some aspects to happen under the Commercial Banking Act B.E. 2505 – by relating to various concerning legislations, banking documents, certain bank staff members and commercial bank examiners’ experiences in their work. This thesis comprises explanations on good administration under the law, the difficulties of commercial banks in being law-abiding; and legal loopholes. The writer has revealed all said points in the thesis, not for the benefit of banks to take advantage of the legal loopholes – for they may face punishments; but to present the write points of view in a straightforward term and the best information available. A research on the problems has disclosed that the Act maintains a large number of loopholes and certain articles that cause difficulties to the operation of banks. Thus, the law itself should be revised. And furthermore, a new legislation should be imposed to allows commercial banks to operate toward the Government’s will and policy. It should be flexible as much as possible and give reasonably adequate powers to the Ministry of Finance, the Bank of Thailand and commercial bank examiners. The writer, not as an official of the Department of Financial Institution Supervision and Examination, the Bank of Thailand, but a post-graduate student has made criticism and evaluation of the problems in this thesis. Various views are personally presented without any relevance to the Department concerned. The opinion, finally, is not meant to be agreed by other officials of the Department.
