Abstract:
การปฏิบัติหน้าที่ของสมาชิกรัฐสภาในฐานะตัวแทนของประชาชนมีจุดมุ่งหมายเพื่อประโยชน์สาธารณะ ดังนั้น รัฐธรรมนูญโดยเฉพาะทุกประเทศที่ปกครองระบอบประชาธิปไตยแบบตัวแทน จึงมอบสิทธิเหนือกว่าบุคคลธรรมดาทั่วไปโดยหลักสากลและกฎหมาย เอกสิทธิ์ ซึ่งมีอยู่ 2 ประเภท คือ หนึ่งประเภทเป็นเอกสิทธิเกี่ยวกับสิทธิ – เสรีภาพ คือ เป็นเอกสิทธิ์ขั้นต้นที่สมาชิกรัฐสภาต้องได้รับ ซึ่งเป็นเอกสิทธิ์เกี่ยวกับความมีอิสระในการพูด และประเภทที่สอง เป็นเอกสิทธิ์ทางกฎหมาย อันเป็นเอกสิทธิ์ลำดับที่สอง โดยเกี่ยวกับการกระทำทางกายภาพของสมาชิกรัฐสภา ดังนั้น เอกสิทธิ์ทั้งสองประเภทดังกล่าว จึงนำมาสู่การมีความคุ้มกันสมาชิกรัฐสภา (Immunity) ทั้งนี้ ความคุ้มกันสมาชิกรัฐสภา หมายถึง ผลสืบเนื่องจากการมีเอกสิทธิ์ในความมีอิสระทั้งในด้านการพูด (Privilege of Freedom of Speech) และด้านการไม่ถูกจับกุม (Privilege of Freedom from Arrested) โดยความคุ้มกันจะมีผลก็ต่อเมื่อมีการกระทำที่อาจละเมิดต่อบุคคลอื่นทั้งในแง่ของการพูด หรือการกระทำทางกายภาพในฐานะสมาชิกรัฐสภาและเข้าเงื่อนไขการได้รับความคุ้มกันรัฐสภา การวิจัยในครั้งนี้จะศึกษาความคุ้มกันสมาชิกรัฐสภาที่มีผลสืบเนื่องจากการมีเอกสิทธิ์ในความมีอิสระในการไม่ถูกจับกุมตามบทบัญญัติของรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550 มาตรา 131 ประเทศไทยได้รับแนวคิดเกี่ยวกับความคุ้มกันสมาชิกรัฐสภาจากการมีเอกสิทธิ์เกี่ยวกับความมีอิสระในการไม่ถูกจับกุมจากประเทศอังกฤษและประเทศฝรั่งเศส โดยเริ่มบัญญัติไว้ในรัฐธรรมนูญตั้งแต่ภายหลังการเปลี่ยนแปลงการปกครองเป็นระบอบประชาธิปไตยโดยส่วนใหญ่เป็นไปตามหลักสากล แต่เมื่อนำมาปรับใช้ในทางปฏิบัติกลับไม่เป็นไปตามความมุ่งหมายของหลักการ โดยปัญหาที่พบในทางปฏิบัติในการให้ความคุ้มกันสมาชิกสภาในประเทศไทย มีดังนี้ หนึ่งปัญหาเกี่ยวกับกระบวนการให้ความคุ้มกันสมาชิกรัฐสภาซึ่งไม่มีกระบวนการกลั่นกรองและตรวจสอบก่อน สองปัญหาด้านบุคคลหรือองค์กรผู้ให้ความคุ้มกันสมาชิกรัฐสภาซึ่งให้ดุลพินิจโดยลำพัง โดยไม่มีองค์กรหรือกระบวนการใดในการช่วยกลั่นกรองและตรวจสอบข้อเท็จจริงในเบื้องต้น และสามปัญหาด้านขอบเขตของคดีอาญาที่ให้ความคุ้มกันสมาชิกรัฐสภาที่รวมถึงการกระทำความผิดที่ไม่เกี่ยวข้องกับการปฏิบัติหน้าที่ของรัฐสภา จากปัญหาทั้งหมดจึงอาจกระทบต่อหลักความเสมอภาคและหลักนิติธรรมได้
