dc.description.abstract	อาชญากรรมทางคอมพิวเตอร์เป็นอาชญากรรมอีกประเภทหนึ่งที่เป็นภัยร้ายแรงและส่งผลกระทบอย่างมากต่อสังคม รวมทั้งก่อให้เกิดมูลค่าความเสียหายอย่างมหาศาลต่อระบบเศรฐกิจในปัจจุบัน การกระทำผิดโดยการหลอกลวงทางอินเตอร์เน็ตเป็นประเภทหนึ่งของอาชญากรรมทางคอมพิวเตอร์ที่รัฐจะต้องให้ความสำคัญและควบคุมอย่างใกล้ชิด เนื่องจากการหลอกลวงทางอินเตอร์เน็ตเป็นอาชญากรรมที่ใช้เทคโนโลยีสมัยใหม่เป็นเครื่องมือในการ กระทำความผิด กอปรกับบทบัญญัติของกฎหมายที่มีอยู่ไม่ทันสมัย ขาดประสิทธิภาพ ทำให้มีข้อจำกัดในการบังคับใช้กฎหมายและใช้อำนาจของรัฐในการป้องกันและปราบปรามต่อการกระทำผิดที่เกิดขึ้น เกิดความยากลำบากแก่เจ้าหน้าที่ของรัฐในการเข้าไปดำเนินการจับกุมผู้กระทำผิดได้ จากการศึกษาพบว่ามีปัญหาในการบังคับใช้ประมวลกฎหมายอาญากับอาชญากรรมทางคอมพิวเตอร์โดยเฉพาะการหลอกลวงทางอินเตอร์เน็ต อาทิเช่น ปัญหาเรื่องการกำหนดฐานความผิด ปัญหาเรื่องผู้กระทำความผิด มาตราการลงโทษไม่เหมาะสมต่อความเสียหายที่เกิดขึ้น ปัญหาเรื่องการสืบสวนสอบสวนในคดีอาญา ปัญหาเรื่องการรับฟังพยานอิเล็กทรอนิกส์ ปัญหาเรื่องการพิสูจน์ข้อเท็จจริงเพื่อให้ศาลลงโทษจำเลย และปัญหาเกี่ยวกับองค์กรที่บังคับใช้กฎหมาย ซึ่งในปัจจุบันรัฐบาลได้ตระหนักถึงความเสียหายที่จะตามมา จึงได้มีการยกร่างกฎหมายว่าด้วยอาชญากรรมทางคอมพิวเตอร์ พ.ศ. ขึ้น เพื่อบังคับใช้ต่อการกระทำความผิดเกี่ยวกับคอมพิวเตอร์โดยเฉพาะ ทั้งนี้ผู้เขียนได้สรุปผลการวิจัยเกี่ยวกับปัญหาต่าง ๆ ข้างต้นที่เกี่ยวข้องกับการกระทำผิดโดยการหลอกลวงทางอินเตอร์เน็ต วิเคราะห์ร่างพระราชบัญญัติ ว่าด้วยอาชญากรรมคอมพิวเตอร์ พร้อมทั้งเสนอแนะแนวทางที่ควรจะเป็นในการแก้ไขปัญหาดังกล่าวด้วย
dc.description.abstractalternative	Computer Crimes are harmful acts, which have a deep impact on Society since they cause great monetary losses for the global economy. In particular, governments should focus their attention on controlling Internet fraud. While Internet fraud requires hi-technology to commit delinquent acts, present laws are too outdated and inefficient. Moreover, enforcement of these laws is often limited and not performed in timely fashion. Thailand’s laws regarding computer-related crimes are a case in point. Thailand’s Criminal Code does not adequately address computer-related crimes such as Internet fraud. First, the Criminal Code does not adequately define computer related crimes. Second, the Criminal Code does not address how authorities might apprehend and question computer criminals vis-.-vis criminal procedure law, or how electronic evidence is to be handled or presented. Third, the statutory penalties provided in the Criminal Code do not match the damages resulting from computer crimes. The Thai Government has attempted to address these and other problems pertaining to computer related crimes by drafting a Computer Crimes Bill. เท this thesis, the author summarizes this new Bill, comments on its efficiency, and offers some additional suggestions to further tackle computer-related crimes, in particular Internet fraud.
