dc.description.abstract	ปัจจุบันการก่อนการร้ายจัดว่าเป็นอาชญากรรมร้ายแรงที่สร้างความเสียหายต่อชีวิต และร่างกายตลอดจนทรัพย์สินของผู้บริสุทธิ์เป็นอย่างมาก จนมีการขยายขอบเขตกลายเป็นองค์กรก่อการร้ายข้ามชาติซึ่งยากต่อการปราบปราม ปัจจัยหนึ่งที่ทำให้การก่อการร้ายดำรงอยู่ได้คือ การได้รับปัจจัยสนับสนุนทางการเงินจากแหล่งต่าง ๆ โดยมักจะหลีกเลี่ยงไม่ทำธุรกรรมผ่านสถาบันการเงิน เพื่อให้ยากต่อการตรวจสอบติดตามร่องรอยทางการเงินเช่น การบริจาคผ่านองค์กรที่ดำเนินการโดยไม่มุ่งหวังกำไร หรือการขนเงินสด แม้ประเทศไทยจะได้บัญญัติให้การก่อการร้ายเป็นความผิดตามพระราชกำหนดแก้ไขเพิ่มเติมประมวลกฎหมายอาญา และให้เป็นความผิดมูลฐานตามพระราชกำหนดแก้ไขเพิ่มเติมพระราชบัญญัติป้องกันและปราบปรามการฟอกเงิน พ.ศ. 2542 พ.ศ. 2546 เพื่อให้สามารถนำมาตรการริบทรัพย์ทางแพ่งและทางอามาใช้บังคับเงินทุนเหล่านี้นับว่ายังไม่เพียงพอ เนื่องจากเงินทุนการก่อการร้ายนับว่าเป็นการฟอกเงินสะอาด การที่จะนำมาตรการป้องกันและปราบปรามการฟอกเงินมาใช้บังคับจึงค่อนข้างจะมีปัญหาต่อการบังคับใช้ ด้วยเหตุนี้จึงจำเป็นที่จะต้องศึกษาพระราชบัญญัติป้องกันและปราบปรามการฟอกเงิน พ.ศ.2542 เพื่อวิเคราะห์หามาตรการทางกฎฟมายอันเหมาะสมมาใช้บังคับเงินสะอาดเหล่านี้ อันเป็นการตัดวงจรทางการเงินมิให้นำไปใช้สนับสนุนการก่อการร้ายได้ ตลอดจน หาแนวทางป้องกันมิให้องค์กรที่ดำเนินการโดยไม่มุ่งหวังกำไรต้องตกไปเป็นเครื่องมือที่ไม่ชอบของการก่อการร้ายได้อีกต่อไป	en_US
dc.description.abstractalternative	At present, the offences of terrorism has been a serious crime that causes death, bodily harm body to other person and properties of innocent person, and changes to transnational organized crime, is hard to suppression. As a matter of factor terrorism is received provided material support by various sources, causes still in present. More over, the terrorist fund avoids transaction to pass financial institutions, so it is very hard to checks follow trans fund, as donation to non-profit organizations or cash courier. According to Thailand legal provisions offences terrorism, that added by Section 4 of the Penal Code Amendment Act, B.E.2546, and otherwise provisions offences relating to terrorism under the Penal Code is also predicate offence that added by Section 3 of the Amendments to the Anti-Money Laundering Act of B.E. 2542 B.E. 2546, for uses measure civil forfeiture and criminal forfeiture these asset which dirty money but is not enough because of terrorist fund is clean money, so may be problem for use these measures. There for, it is necessary to study the Anti-Money Laundering Act of B.E.2542, for analysises to find measure legality for enforcement clean money that is material support and proceeds of crime, that protects terrorist fund and do not uses abuse of non-profit organizations in the future.	en_US
