| Abstract: | ศึกษาความเหมาะสมของการนำสัญญามาตรฐาน FIDIC (1999) มาใช้ในอุตสาหกรรมก่อสร้างของประเทศไทย เพื่อวิเคราะห์ปัญหาของสัญญา FIDIC (1999) รวมถึงการเสนอแนะแนวทางในการป้องกันปัญหาดังกล่าว ขั้นตอนของการศึกษาประกอบด้วย ศึกษาเอกสารที่เกี่ยวข้อง วิเคราะห์ปัญหาขั้นต้นของสัญญา ประเมินความเหมาะสมในการนำสัญญามาตรฐาน FIDIC (1999) มาใช้ในประเทศไทย และประเมินผลกระทบของปัญหาต่อประสิทธิภาพในการบริหารสัญญา และวิเคราะห์หาแนวทางการป้องกันปัญหาดังกล่าว การประเมินความเหมาะสมในการนำสัญญามาใช้ในประเทศไทย และการประเมินผลกระทบต่อประสิทธิภาพในการบริหารสัญญา ใช้วิธีการทำแบบสอบถามความคิดเห็นของ ผู้ที่เกี่ยวข้องกับการใช้สัญญาจ้างก่อสร้างทุกฝ่าย ได้แก่ ฝ่ายผู้ว่าจ้าง ฝ่ายวิศวกรผู้ควบคุมงาน และฝ่ายผู้รับจ้าง จำนวน 82 คน โดยใช้เทคนิคการหาฉันทามติ วิธีเดลฟายแบบปรับปรุง (Modified Delphi Technique) ผลการศึกษาสรุปว่า สัญญามาตรฐาน FIDIC (1999) เป็นสัญญาที่สามารถนำมาใช้ในประเทศไทยได้อย่างมีประสิทธิภาพ แต่อย่างไรก็ตาม สัญญา FIDIC (1999) ยังคงมีปัญหาซึ่งสามารถที่จะปรับปรุงแก้ไข เพื่อให้สามารถนำมาใช้ในประเทศไทยได้ อย่างมีประสิทธิภาพมากขึ้นจำนวนทั้งสิ้น 13 ปัญหา แบ่งเป็นปัญหาด้านคุณภาพ ด้านต้นทุนและการเงิน ด้านเวลา และด้านสิทธิและหน้าที่อื่นๆ ของคู่สัญญา ปัญหาซึ่งผู้ซึ่งเกี่ยวข้องกับการใช้สัญญาจ้างเห็นว่า มีผลต่อประสิทธิภาพการบริหารสัญญามากที่สุด 3 อันดับแรก ได้แก่ 1) ปัญหาการไม่กำหนดระยะเวลาแก่วิศวกร ในการทำหน้าที่พิจารณาตามที่กำหนดไว้ในสัญญา 2) ปัญหาการไม่กำหนดให้วิศวกรจะต้องได้รับความเห็นชอบ จากผู้ว่าจ้างก่อนสั่งเปลี่ยนแปลงงานที่สำคัญ และ 3) ปัญหาความเป็นกลางของวิศวกร แนวทางการแก้ไขปัญหาดังกล่าวได้แก่ การกำหนดระยะเวลาแก่วิศวกรในการปฏิบัติหน้าที่ตามสัญญา การกำหนดให้วิศวกรต้องได้รับความเห็นชอบ จากผู้ว่าจ้างก่อนสังเปลี่ยนแปลงงานที่สำคัญ ปัญหาความเป็นกลางของวิศวกร เป็นปัญหาที่ยังไม่มีแนวทางแก้ไขที่สมบูรณ์ จึงเป็นข้อเสนอแนะการวิจัยในอนาคตต่อไป |
| Other Abstract: | To address the suitability of FIDIC (1999) standard contract in Thai construction industry, the analysis of problems of FIDIC (1999) contract and the guidelines for improving the contract to alleviate the problems. The study was done by reviewing related documents, analysing basic contract problems, assessment of its suitability and establishing the guidelines for improving the contract. The suitability assessment and the effect assessment were done by processing 82 questionnaires collected from the parties related with the contract administration process, i.e. the employers, the engineers and the contractors. The modified Delphi technique was also used to arrive at common opinions among various respondent group. It was found that FIDIC (1999) contracts can be used in Thiland's construction industry efficiently. Nevertheless, 13 problems still exist. They are devided into 4 groups i.e. quality-related, cost-related, time-related and right-and-duty-related problems. The problems voted to be the three most important problems that effect the contract administration efficiency are 1) the absence of tme-limits for engineer to execute his duties of determination. 2) the engineer's right to order major variation without employer's consent and 3) the contradiction of engineer's roles in contract administration. The guidelines are recommended for improving construction contracts by defining the engineer's time-limits of determination and the requirement of employer's consent for major variation. There are no perfect solutions to solve the problem of contradiction of engineer's roles in this form of contract now. It is recommended to be studied in further researches. |
