| dc.description.abstract | อนุสัญญาสหประชาชาติว่าด้วยกฎหมายทะเล ค.ศ.1982 เป็นอนุสัญญาที่กล่าวถึงการคุ้มครองและการรักษาสิ่งแวดล้อมทางทะเลในเรื่องสิทธิ หน้าที่ และการใช้อำนาจของรัฐภาคีอย่างครอบคลุม แต่อนุสัญญาฯ เป็นอนุสัญญาที่วางหลักเกณฑ์ไว้อย่างกว้างๆ เนื่องจากอนุสัญญาฯ ประสงค์ให้นำเอากฎเกณฑ์และมาตรฐานที่ได้มีการเสนอแนะในระหว่างประเทศมาพิจารณาในการออกกฎหมายและข้อบังคับ และบังคับให้เป็นไปตามกฎหมาย วิทยานิพนธ์ฉบับนี้ มุ่งที่จะศึกษาถึงแนวทางการอนุวัตการกฎหมายไทยเกี่ยวกับการคุ้มครองและรักษาสิ่งแวดล้อมทางทะเลตามที่อนุสัญญากฎหมายสหประชาชาติว่าด้วยกฎหมายทะเล ค.ศ.1982 และอนุสัญญาอื่นๆ ที่เกี่ยวข้องกับการป้องกัน ลด และควบคุมภาวะมลพิษทางทะเลเพื่อหาแนวทางในการปรับปรุงกฎหมายไทยให้สอดคล้องตามอนุสัญญาสหประชาชาติว่าด้วยกฎหมายทะเล ค.ศ. 1982 โดยผู้เขียนได้ทำการศึกษาใน 4 ประเภทภาวะมลพิษ ได้แก่ ภาวะมลพิษจากแหล่งบนบก ภาวะมลพิษจากกิจกรรมที่พื้นใต้ท้องทะเลภายใต้เขตอำนาจแห่งชาติ ภาวะมลพิษจากการทิ้งเท และภาวะมลพิษจากเรือ หากประเทศไทยจะต้องมีการให้สัตยาบันตามสหประชาชาติว่าด้วยกฎหมายทะเล ค.ศ. 1982 แนวทางการปรับปรุงแก้ไขกฎหมายที่ผู้ขียนได้เสนอแนะก็จะสามารถนำมาใช้ในการปรับปรุงแก้ไขกฎหมายของประเทศไทยในเรื่องที่เกี่ยวข้องได้ ผลการศึกษาพบว่าประเทศไทยมีกฎหมายที่เกี่ยวข้องกับการป้องกัน ลด และควบคุมภาวะมลพิษทางทะเลอยู่แล้ว แต่มีอยู่อย่างกระจัดกระจายในกฎหมายหลายฉบับ และให้อำนาจแต่ละหน่วยงานราชการในการบังคับใช้กฎหมายแต่ละเรื่อง จึงส่งผลต่อความเป็นเอกภาพของการบังคับใช้กฎหมายและทำให้ประเทศไทยมีปัญหาในการคุ้มครองและรักษาสิ่งแวดล้อมทางทะเลอย่างจริงจัง ดังนั้น ประเทศไทยควรจะต้องมีการปรับปรุงแก้ไขกฎหมายไทยตามแนวทางที่กำหนดไว้ตามอนุสัญญาสหประชาชาติว่าด้วยกฎหมายทะเล ค.ศ.1982 และอนุสัญญาอื่นๆ ที่เกี่ยวข้องกับการป้องกัน ลด และควบคุมภาวะมลพิษทางทะเล รวมทั้งการกำหนดให้มีการบังคับใช้กฎหมายโดยหน่วยงานราชการที่เหมาะสม เพื่อเป็นการป้องกัน ลด และควบคุมภาวะมลพิษทางทะเลของไทยให้มีประสิทธิผลและเป็นมาตรฐานเดียวกับมาตรฐานระหว่างประเทศ | en_US |
| dc.description.abstractalternative | United Nations Convention on the Law of the Sea 1982 (UNCLOS 1982) is the convention extensively stipulating rights, responsibilities and authorities of the State Parties. However, the Convention provides general framework and guidelines as it intends for the Parties to implement and enact their law and regulation by considering international standard and practices. This thesis aims at studying the direction for Thailand’s implementation of the UNCLOS 1982 and other related conventions concerning environment protection and preservation. This study focuses on four sources of pollution including pollution from land-based sources, pollution from sea-bed activities, pollution from dumping and pollution from vessels. That is, once Thailand considers ratifying the UNCLOS 1982, the suggestions provided in this thesis would be beneficial in revising Thai laws to comply with the Convention. The study reveals that Thailand has laws concerning marine environment protection and preservation, but they are in different places and each of them has specific authority to enforce on each aspect of environment laws. Consequently, there is no conformity of government authorities in enforcing the laws. It is therefore necessary to revise Thai laws in accordance with the UNCLOS 1982 and other related conventions and stipulate proper government authority to enforce the laws in order to increase efficiency in Thailand’s environment protection and preservation with international standard. | en_US |
