dc.description.abstract	วิทยานิพนธ์ฉบับนี้มีสมมติฐานว่า ปัจจัยเชิงสถาบัน อันได้แก่ นโยบายรัฐบาลนโยบายสำนักงานตำรวจแห่งชาติ จรรยาบรรณตำรวจ คำสั่งผู้บังคับบัญชา มีอิทธิพลต่อพฤติกรรมของเจ้าหน้าที่ตำรวจผู้ปฏิบัติหน้าที่ในการชุมนุมสาธารณะมากกวาบทบัญญัติรัฐธรรมนูญในเรื่องสิทธิและเสรีภาพ จึงนับเป็นการตั้งคำถามว่าระหว่างความสงบเรียบร้อยกับสิทธิเสรีภาพ อะไรเป็นแนวคิดที่มีอิทธิพลต่อการปฏิบัติหน้าที่ของเจ้าหน้าที่ตำรวจในการชุมนุมสาธารณะมากกว่ากัน ผลการศึกษา พบว่า สิทธิเสรีภาพในด้านต่าง ๆ ของประชาชนเป็นสิทธิที่ได้มีการรับรองและคุ้มครองไว้ตามบทบัญญัติรัฐธรรมนูญ ส่วนการรักษาความสงบเรียบร้อยเป็นหน้าที่ของเจ้าหน้าที่ตำรวจตามกฎหมาย โดยปกติในทางปฏิบัติ เจ้าหน้าที่ตำรวจผู้ปฏิบัติหน้าที่ในการชุมนุมสาธารณะ จะฟังคำสั่งของผู้บังคับบัญชาเป็นหลัก คำสั่งดังกล่าวมีที่มาจากนโยบายของสำนักงานตำรวจแห่งชาติที่มีที่มาจากนโยบายของรัฐอีกต่อหนึ่ง ซึ่งให้ความสำคัญกับความสงบเรียบร้อยของบ้านเมืองเป็นหลัก ความสงบเรียบร้อยจึงเป็นเงื่อนไขสำคัญในการปฏิบัติหน้าที่ของเจ้าหน้าที่ตำรวจเกี่ยวกับการชุมนุมสาธารณะ แสดงให้เห็นว่า ปัจจัยเชิงสถาบันอื่น ๆ อันได้แก่ นโยบายของรัฐบาล นโยบายของสำนักงานตำรวจแห่งชาติ และคำสั่งของผู้บังคับ บัญชา มีอิทธิพลต่อพฤติกรรมของเจ้าหน้าที่ตำรวจผู้ปฏิบัติหน้าที่ในการชุมนุมสาธารณะมากกว่าบทบัญญัติรัฐธรรมนูญในเรื่องสิทธิและเสรีภาพ	-
dc.description.abstractalternative	The thesis hypothesized that institutional factors, namely, government policy, the National Police's policy, police code of ethics and superiors’ orders exerted more influence on Thai police officials' behavior เท the conduct of their duties at public assemblies than the provisions of the current 1997 Thai Constitution on rights and freedoms. In other words, the question asked was, between order and freedom, which had more influence on police officials in the conduct of their duties at public assemblies. The study found that rights and freedoms of the people were those which were recognized by and given protection in the constitution, whereas the keeping of the peace was what police officials were duty bound to do by law. In the vast majority of cases, police officials conducting their duties at public assemblies would mainly follow superiors’ orders. Such orders followed National Police’s policy which in turn followed government policy. All three accorded the greatest importance to law and order. Law and order thus constituted the important constraint on police conduct at public assemblies. It can thus be concluded that institutional factors, namely government policy, National Police’s policy and superiors’ order exerted more influnce on the behavior of police officials conducting duties at public assemblies than did the constitutional provisions on rights and freedoms.	-
