Abstract:	งานวิจัยเรื่องภาวะผู้นำของศาสตราจารย์พิเศษพรเพชร วิชิตชลชัย กรณีศึกษา : การดำรงตำแหน่งประธานสภานิติบัญญัติแห่งชาติและประธานวุฒิสภา มีวัตถุประสงค์ของการศึกษา ได้แก่ (1) เพื่อศึกษาภูมิหลังและชีวประวัติของศาสตราจารย์พิเศษ พรเพชร วิชิตชลชัย (2) เพื่อศึกษาความเป็นผู้นำของศาสตราจารย์พิเศษพรเพชร วิชิตชลชัย ในการดำรงตำแหน่งประธานสภานิติบัญญัติแห่งชาติและประธานวุฒิสภา และ (3) เพื่อศึกษาประเมินความเป็นผู้นำของศาสตราจารย์พิเศษพรเพชร วิชิตชลชัย ในการดำรงตำแหน่งประธานสภานิติบัญญัติแห่งชาติและประธานวุฒิสภา โดยใช้วิธีการวิจัยเชิงคุณภาพ (Qualitative Research) ทำการศึกษาจากเอกสาร (Documentary Study) และการสัมภาษณ์เชิงลึกผู้ให้ข้อมูลที่เกี่ยวข้อง (In – depth Interview) 5 กลุ่ม ประกอบด้วย (1) กลุ่มอดีตสมาชิกสภานิติบัญญัติแห่งชาติและสมาชิกวุฒิสภา (2) กลุ่มเจ้าหน้าที่ผู้เกี่ยวข้องฝ่ายการเมือง (3) กลุ่มเจ้าหน้าที่ผู้เกี่ยวข้องฝ่ายข้าราชการประจำ (4) บุคคลผู้เห็นต่างในการทำหน้าที่ของศาสตราจารย์พิเศษพรเพชร วิชิตชลชัย และ (5) ทำการสัมภาษณ์ศาสตราจารย์พิเศษพรเพชรวิชิตชลชัย เป็นหน่วยการศึกษาหลัก ในการทำหน้าที่ประธานสภานิติบัญญัติแห่งชาติและประธานวุฒิสภา ผลการศึกษาพบว่า (1) ภูมิหลังและชีวประวัติของศาสตราจารย์พิเศษพรเพชร วิชิตชลชัย (socialization) สามารถอธิบายพื้นฐานความเป็นมาของศาสตราจารย์พิเศษพรเพชร ฯ ที่มีผลต่อรูปแบบลักษณะเชิงพฤติกรรมในการทำหน้าที่ทางการเมือง จบการศึกษาระดับมัธยมศึกษาจากวชิราวุธวิทยาลัย ระดับอุดมศึกษาปริญญาตรีจบจากคณะนิติศาสตร์ จุฬาลงกรณ์มหาวิทยาลัย เนติบัณฑิตไทยสำนักอบรมศึกษากฎหมายแห่งเนติบัณฑิตยสภา และปริญญาโทกฎหมายจากมหาวิทยาลัยฮาวาร์ด สหรัฐอเมริกา ด้วยทุนรัฐบาล ก.พ. ตำแหน่งในการรับราชการที่สำคัญตำแหน่งผู้พิพากษาศาลฎีกา ประธานศาลอุทธรณ์ ภาค 4 ผู้พิพากษาหัวหน้าคณะในศาลฎีกา ฯลฯ เป็นอาจารย์สอนวิชากฎหมายในหลายวิทยาลัย จนได้รับพระมหากรุณาธิคุณโปรดเกล้าให้เป็น “ศาสตราจารย์พิเศษ” คณะนิติศาสตร์ จุฬาลงกรณ์มหาวิทยาลัย ในปี 2556 ได้รับพระบรมราชโองการโปรดเกล้าฯ แต่งตั้งเป็นผู้ตรวจการแผ่นดินปี 2557 ได้รับพระบรมราชโองการโปรดเกล้า ฯ แต่งตั้งประธานสภานิติบัญญัติแห่งชาติ ปี 2562 ได้รับพระบรมราชโองการโปรดเกล้า ฯ แต่งตั้งเป็นประธานวุฒิสภา ผ่านการอบรมจากวิทยาลัยป้องกันราชอาณาจักร (วปอ.41) และสถาบันพระปกเกล้า (ปปร.11) ซึ่งภูมิหลังถือหนึ่งในสภาพแวดล้อมที่ช่วยขัดเกลาความเป็นผู้นำของศาสตราจารย์พิเศษพรเพชร ฯ ในกรอบของชนชั้นนำและมุมมองความคิดที่ยึดถือกฎหมายเป็นหลักอย่างเข้มแข็ง ในส่วนของการหล่อหลอมจากครอบครัว ศาสตราจารย์พิเศษพรเพชร ฯ เติบโตในครอบครัวชนชั้นกลาง สมาชิกในครอบครัวรับราชการ ซึ่งมีผลต่อทัศนคติในการชีวิตและการทำงาน สำหรับบุคลิกที่โดดเด่นในทัศนะของผู้ให้ข้อมูลโดยส่วนใหญ่มองว่า เป็นผู้ที่มีมนุษยสัมพันธ์ที่ดี มีความ มุ่งมั่น ทุ่มเท ทั้งในการเรียนรู้ และการใช้ชีวิต สำหรับอุปนิสัยเป็นคนมีเมตตามีคุณธรรม มีความยุติธรรม มีความอดทน และได้รับความไว้วางใจจากบุคคลสำคัญ ให้ปฏิบัติหน้าที่อันสำคัญต่อประเทศชาติในระดับสูงสุดหลายครั้งหลายครา สำหรับเกียรติประวัติภายหลังการดำรงตำแหน่งในระดับสูง คือ ได้รับคัดเลือกเป็นนิสิตเก่าดีเด่นของจุฬาลงกรณ์มหาวิทยาลัยนักเรียนทุนรัฐบาลดีเด่น (2) บทบาทผู้นำของศาสตราจารย์พิเศษพรเพชร วิชิตชลชัย ในการดำรงตำแหน่งประธานสภานิติบัญญัติแห่งชาติและประธานวุฒิสภา (leadership) ผู้ให้ข้อมูลในภาพรวมเห็นพ้องกันว่า เป็นผู้ที่มีความเหมาะสมในการเป็นผู้นำฝ่ายนิติบัญญัติทั้งจากพฤติกรรมและคุณสมบัติเฉพาะตัวสำหรับลักษณะเชิงพฤติกรรมการเป็นผู้นำที่สำคัญต่อการดำรงตำแหน่งหลายประการ ได้แก่ การวางตัวเป็นกลาง ไม่มีคู่ขัดแย้งในช่วงที่สถานการณ์ทางการเมืองมีความรุนแรง มีความเป็นผู้นำ จิตใจดีน่าเคารพ และเป็นที่ยอมรับจากผู้ร่วมภารกิจ มีความอดทน ประนีประนอม และเข้มแข็งในเวลาอันเหมาะสม ฯลฯ อย่างไรก็ตาม การดำรงตำแหน่งทางการเมือง ประธานสภานิติบัญญัติแห่งชาติและประธานวุฒิสภา ของศาสตราจารย์พิเศษพรเพชร ฯ มีการแสดงบทบาทผู้นำคล้ายคลึงและแตกต่างกันบ้างในบางส่วน คือ สภานิติบัญญัติแห่งชาติได้ให้ความสำคัญกับการออกกฎหมายเพื่อปฏิรูปการเมืองซึ่งถือว่ามีความเบ็ดเสร็จ สมบูรณ์ ขณะที่วุฒิสภาทำหน้าที่ออกกฎหมาย แต่งตั้งผู้ดำรงตำแหน่งทางการเมืองควบคุมการบริหารราชการแผ่นดินให้ความเห็นชอบในเรื่องสำคัญต่าง ๆ เช่น พิจารณาให้บุคคลดำรงตำแหน่งหรือถอดถอนบุคคลออกจากตำแหน่ง ร่วมกับฝ่ายบริหารในการพัฒนาประเทศ ฯลฯ ทำให้การปฏิบัติงานจึงมีความสัมพันธ์กับกลไกทางการเมืองและการบริหารราชการแผ่นดินตามกฎหมายที่ค่อนข้างหลากหลาย บทบาทการนำของศาสตราจารย์พิเศษพรเพชร ฯ จึงเป็นไปหลายรูปแบบและทำให้การบริหารกิจการงานสภาทั้งสองจึงให้ผลแตกต่างกันในบางครั้ง โดยการทำหน้าที่เป็นประธานวุฒิสภา เกิดอุปสรรคในบางครั้ง เนื่องจากการแสดงพฤติกรรมการไม่เคารพการปฏิบัติหน้าที่ของตัวแสดงทางการเมือง เป็นต้น สะท้อนถึง การเป็นผู้นำที่ยังไม่เด็ดขาดในบางครั้งจากจังหวะในการระงับการถกเถียงในการประชุม ที่ทำให้สภาอาจไม่บรรลุเป้าหมายของการประชุม และในด้านการบริหารอำนาจผ่านการมอบหมายและสั่งการ ซึ่งยังไม่สามารถสร้างสมดุลในการมอบหมายสั่งการได้อย่างมีประสิทธิภาพนัก (3) การประเมินความเป็นผู้นำของศาสตราจารย์พิเศษพรเพชร วิชิตชลชัย ในการดำรงตำแหน่งประธานสภานิติบัญญัติแห่งชาติและประธานวุฒนิสภา (leaderization) จากข้อมูลของผู้ให้สัมภาษณ์เห็นตรงกันว่าการปฏิบัติงานของศาสตราจารย์พิเศษพรเพชร ฯ ในหน้าที่ประธานสภานิติบัญญัติแห่งชาติ และประธานวุฒิสภา มีความคล้ายคลึงกันในลักษณะของภารกิจ คือ เป็นผู้นำฝ่ายนิติบัญญัติเช่นเดียวกัน หากแต่องค์ประกอบของสถาบันทั้งสองมีความแตกต่างกันอยู่บ้างจากที่มาของสมาชิกภายในสถาบันและบทบาทหน้าที่ของฝ่ายนิติบัญญัติทั้งสอง สำหรับการปฏิบัติหน้าที่ ในฐานะประธานสภานิติบัญญัติแห่งชาติ เป็นไปได้อย่างคล่องตัวจากความเป็นเอกภาพของสภากลยุทธ์เพื่อรักษาการนำหรือการแสดงออกถึงความเป็นผู้นำ จึงเน้นการใช้กลยุทธ์เฉพาะตัวและเน้นการแลกเปลี่ยนความต้องการและความคิดเห็นกับสมาชิกอย่างสม่ำเสมอ มีการใช้กลยุทธ์ความโปร่งใสและประนีประนอม กลยุทธ์การมีส่วนร่วม กลยุทธ์ความสุภาพน่าเคารพ กลยุทธ์จากความรู้เฉพาะทางด้านกฎหมาย เป็นต้น กลยุทธ์เหล่านี้ถือเป็นวิธีการที่สนับสนุนให้ศาสตราจารย์พรเพชรฯ สามารถสร้างการมีส่วนร่วมและความเห็นพ้องต้องกันอย่างเป็นเอกภาพ ขณะที่วุฒิสภาแม้ว่าจะมีที่มาจากการแต่งตั้งหากแต่ความหลายหลายและภารกิจงานของวุฒิสภายังมีภารกิจที่หลากหลาย การปฏิบัติหน้าที่จึงมีกลยุทธ์ในหลายรูปแบบ อาทิ กลยุทธ์เฉพาะตัว ที่เน้นความรู้ความสามารถเฉพาะทางด้านกฎหมาย ความประนีประนอม โปร่งใส และมีส่วนร่วม ขณะเดียวกันก็มีการเตรียมพร้อมรับมือกับความเสี่ยงทุกครั้งที่ต้องดำเนินภารกิจ ซึ่งเป็นบุคลิกเชิงพฤติกรรมที่ได้รับการพัฒนามาโดยตลอด กลยุทธ์ตามสถานการณ์ที่แสดงออกในบทบาทผู้นำประนีประนอมและผู้นำที่เข้มแข็งเด็ดขาดตามจังหวะของสถานการณ์มีทั้งความขัดแย้งและความร่วมมือ รวมถึงในบางครั้งยังมีการปล่อยให้สถานการณ์ปัญหาดำเนินตัวเองไปโดยคำนึงถึงเป้าหมายที่ภารกิจต้องการบรรลุความต้องการเป็นหลักสำคัญ นอกจากนี้ในสถานะการปฏิบัติงานประธานวุฒิสภา ยังมีการใช้กลยุทธ์ที่นำไปสู่การนำแบบยั่งยืนด้วยการเน้นหลักความยุติธรรมตามกฎหมายและให้ความสำคัญกับการมีส่วนร่วมจากทุกฝ่ายค่อนข้างมาก เพื่อให้สภาเป็นพื้นที่ของการแลกเปลี่ยนระหว่างสมาชิกอย่างสมดุล เพื่อให้ภารกิจของสภามบรรลุผลสำเร็จ แต่ในอีกทางหนึ่งพบว่า เมื่อมีการประชุมวุฒิสภาหรือมีการประชุมร่วมกันของรัฐสภา ศาสตราจารย์พิเศษพรเพชร ฯ สามารถแสดงบทบาทความเป็นผู้นำและมีการปรับตัวตามสถานการณ์ในการดำเนินกิจการสภาได้เป็นอย่างดีแทบทุกครั้ง แต่ในขณะเดียวกันการดำเนินกิจการสภา ในช่วงการดำรงตำแหน่งประธานวุฒิสภา ต้องใช้ความพยายามจะควบคุมการประชุมให้สงบเรียบร้อย เนื่องด้วยมีสมาชิกสภาบางส่วนที่คอยยั่วยุ หรือสร้างความไม่สะดวกในการดำเนินกิจการสภาทั้ง 2 สภา ซึ่งถือเป็นความท้าทายในการแสดงบทบาทความเป็นผู้นำ ถึงแม้ศาสตราจารย์พิเศษพรเพชร ฯ จะพยายามปรับตัวตามสถานการณ์และใช้กลยุทธ์ต่าง ๆ ในการดำเนินกิจการสภาแต่ก็ยังพบว่า ความสุขุม นุ่มนวล ประนีประนอม เปิดใจยอมรับฟังผู้อื่น ยังไม่สามารถทำให้กิจการสภาดำเนินไปอย่างมีประสิทธิภาพเท่าที่ควร อีกทั้งคุณลักษณะเฉพาะของตัวศาสตราจารย์พิเศษพรเพชร ฯ ที่แสดงออกส่งผลถึงการรับรู้ของบุคคลบางกลุ่มและสะท้อนว่า สิ่งที่เป็นปัญหาอุปสรรคของศาสตราจารย์พิเศษพรเพชร ฯ คือบุคลิกส่วนตัวของศาสตราจารย์พิเศษพรเพชรฯ ไม่ค่อยแสดงความเป็นกันเอง ขาดปฏิสัมพันธ์ต่อคนหมู่มาก จึงทำให้บุคคลทั่วไปไม่สามารถที่จะแลกเปลี่ยนข้อมูลกับท่านได้อย่างตรงไปตรงมาอีกทั้งบุคลิกความเป็นคนผู้นำที่ตรงไปตรงมา แต่ขาดวาทศิลป์ในการจัดการจึงก่อให้เกิดความขัดแย้งหรือความไม่เข้าใจอันดีกับเพื่อนสมาชิกสภาเช่นเดียวกัน
Other Abstract:	The study on the Leadership of Professor Pornpetch Wichitcholchai Case Study : holding the position as President of the National Legislative Assembly and the President of the Senate has the purposes (1) to study the background and biography of Professor Pornpetch Wichitcholchai (2) to study the leadership of Professor Pornpetch Wichitcholchai in holding the position as President of the National Legislative Assembly and the President of the Senate and (3) to evaluate the leadership of Professor Pornpetch Wichitcholchai by applying Qualitative Research based on documentary study andin-depth interviews of 5 groups of representatives including (1) former members of the National Legislative Assembly and members of the Senate (2) officials related to political affairs (3) permanent officials who are related to the President’s affairs (4) representatives who oppose Professor Pornpetch Wichitcholchai’s duties (5) interview of Professor Pornpetch Wichitcholchai, the main person in this study, as President of the National Legislative Assembly and President of the Senate Results from the study showed that (1) the background and biography of Professor Pornpetch Wichitcholchai (socialization) can be used to explain his life story which may affect his political duties. Professor Wichitcholchai graduated high school from Vajiravudh College, Bachelor of Law from the Faculty of Law, Chulalongkorn University, Thai Barrister from the Institute of Legal Education of the Thai Bar, and Masters of Law from Harvard University, USA by the Royal Thai Government Scholarship. Professor Wichitcholchai has work experiences as follows; Judge of the Supreme Court, President of the Court of Appeal (District 4), Chief Judge of the Supreme Court etc. Moreover, Professor Wichitcholchai has taught law courses in many universities, therefore he was given the title “Professor” by Chulalongkorn University in 2013 and appointed as Ombudsman in 2014. Further in 2019, Professor Wichitcholchai was appointed President of the Senate, as well as passing the training course from the National Defense College (NDC.41)and King Prajadhipok’s Institute. These backgrounds has shaped Professor Wichitcholchai’s leadership by reflecting his middle class stamina and strong legal opinion. In family background, Professor Wichitcholchai grew up in a middle class family who are mostly civil servants. This has also influenced his professional and personal outlook. According to information received from most representatives, Professor Wichitcholchai is kind, friendly, hard-working, eager to learn in both life and work. His mannerisms include generosity, just, fair, tolerance and always receive trust from important persons in performing national-level duties. As for professional records after being appointed high-ranking positions, Professor Wichitcholchai was selected as Chulalongkorn University’s prominent graduate and prominent Royal Thai Scholarship student. (2) The leadership roles of Professor Pornpetch Wichitcholchai as President of the National Legislative Assembly and President of the Senate, interviewed representatives gave information that Professor Wichitcholchai is suitable for this legislative position considering from his characteristics and personal mannerisms. These include remaining neutral in conflicting political situations, being good natured, being respectful, accepted by his peers, tolerant, compromising, and brave in certain situations. However, holding positions as the President of the National Legislative Assembly and the President of the Senate of Professor Pornpetch Wichitcholchai reflected both similar and different aspects in his leadership. While being President of the National Legislative Assembly, his main duties were to draft legislation for political reform which is considered total and complete. As for being the President of the Senate, his main duties were to draft legislation, appoint political representatives, controlling public administration issues including appointing or demoting a person from a political position along with the administrative sector etc. As a result, Professor Wichitcholchai’s duties are related to various political and public administration procedures. Professor Wichitcholchai’s leadership has then been portrayed in many practices, affecting his performances in certain circumstances. For example, some obstacle occurred while holding his position as President of the Senate including impolite behavior of political actors. This reflected the President of the Senate’s flaws in leadership and inability to control conflicting situations during Senate sittings. The results of the sitting, as a result, may not be concluded as planned and the power of assigning or giving orders to other representatives became imbalanced and less efficient. (3) The evaluation of Professor Pornpetch Wichitcholchai’s leadership in holding positions as the President of the National Legislative Assembly and the President of the Senate from the interviewed representatives, information shown that Professor Wichitcholchai’s leadership in both positions has similarities. These include both positions being legislative leaders, however the difference would be the roles of members of the National Legislative Assembly and the Senate. While holding position as the President of the National Legislative Assembly, Professor Wichitcholchai was able to perform his duties accordingly due to the solidarity of the institution at that time. Moreover, Professor Wichitcholchai has proved his leadership ability by being transparent, compromising, participation, politeness and well-honored as well as having intensive knowledge about law. These abilities have enforced Professor Wichitcholchai to be able to encourage his peers to participate and agree with certain issues, even if members of the Senate. Furthermore, the Thai Senate has numerous missions where members of the Senate from various backgrounds have to adopt their knowledge and experiences to complete their duties. Apart from knowledge about law, the President of the Senate should have compromising skills and be transparent, also be ready for any risky situations before hand. Thus, his ability to control conflicting situations has developed throughout his tenure, in some cases leaving the situation to resolve on its own according to the reasons involved but aiming for the final solution. Most importantly, while holding position as President of the Senate, Professor Wichitcholchai applied the sustainable leadership strategy by being legally just and fair, focusing on the participation of all representatives and members in order to complete the missions of the Senate successfully. On the other hand, during Senate sittings Professor Wichitcholchai is able to perform his duties that reflect his leadership well. However, during all the parliamentary sittings and parliamentary affairs, the President of the Senate must be able to control every situation that may happen during the sittings, being a challenge on his leadership capability. Mostly, members of parliament may cause disruption or conflict during parliamentary sittings. Although Professor Wichitcholchai tried to control conflicting situations during parliamentary sittings with his calm, polite gentle, and open-minded demeanor, certain members and persons view his personality as unwelcoming. This may be implied that Professor Wichitcholchai's reclusive personality has prevented other people from having interaction and exchanging views on relevant matters with him. Moreover, his direct mannerism in making decisions and lacking appropriate verbal communication management may have affected his relationship among his fellow members of parliament
