| Abstract: | พนักงานสอบสวน กองกำกับการ 2 กองบังคับการปราบปรามการกระทำความผิดเกี่ยวกับอาชญากรรมทางเศรษฐกิจ ซึ่งมีหน้าที่และอำนาจในการรวบรวมพยานหลักฐาน และการดำเนินการต่าง ๆ ตามประมวลกฎหมายวิธีพิจารณาความอาญา เกี่ยวกับภาษีอากรทั่วราชอาณาจักร ตามพระราชบัญญัติศุลกากร พ.ศ.2560, พระราชบัญญัติภาษีสรรพสามิต พ.ศ.2560 และประมวลรัษฎากร ซึ่งในปัจจุบัน มีแนวโน้มจำนวนคดีและมูลค่าความเสียหายสูงขึ้นเรื่อย ๆ ตั้งแต่ พ.ศ.2563 ในปีที่มีการระบาดของโรคติดเชื้อไวรัสโคโรนา 2019 (COVID-19) ซึ่งเป็นสาเหตุทำให้ต้องงดการเดินทางเข้า-ออก ประเทศ เศรษฐกิจของประเทศตกต่ำ และประชาชนเกิดการว่างงาน แน่นอนว่าเป็นที่มาของการก่ออาชญากรรมทางภาษีเพิ่มขึ้น นอกจากนี้แต่ละคดีจะปริมาณเอกสารและขั้นตอนการดำเนินการแต่ละคดีมีเป็นปริมาณมาก เมื่อเทียบกับกองกำกับการอื่น ๆ และสถานีตำรวจท้องที่ในสังกัดสำนักงานตำรวจแห่งชาติ อีกทั้งกฎหมายภาษีถือเป็นกฎหมายพิเศษซึ่งมีความซับซ้อนสูง ไม่สามารถโอนสำนวนไปให้สถานีตำรวจท้องที่ดำเนินการได้ เหมือนหน่วยงานอื่น ดังนั้นผู้วิจัยจึงเลือกที่จะทำสารนิพนธ์ในหัวข้อ “การพัฒนาประสิทธิภาพการบริหารจัดการงานของพนักงานสอบสวน กรณีศึกษา กองกำกับการ 2 กองบังคับการปราบปรามการกระทำความผิดเกี่ยวกับอาชญากรรมทางเศรษฐกิจ” เพื่อที่หาแนวทางที่เหมาะสมในการพัฒนาประสิทธิภาพการบริหารจัดการงานของพนักงานสอบสวน กองกำกับการ 2 กองบังคับการปราบปรามการกระทำความผิดเกี่ยวกับอาชญากรรมทางเศรษฐกิจ การทำสารนิพนธ์ในหัวข้อดังกล่าว มีวัตถุประสงค์เพื่อทราบถึงปัญหาและอุปสรรคในการพัฒนาประสิทธิภาพการบริหารจัดการงาน และแนวทางในการพัฒนาประสิทธิภาพการบริหารจัดการงานของพนักงานสอบสวน กองกำกับการ 2 กองบังคับการปราบปรามการกระทำความผิดเกี่ยวกับอาชญากรรมทางเศรษฐกิจ โดยใช้ระเบียบวิธีวิจัยเชิงคุณภาพ ซึ่งจะทำการรวบรวมข้อมูลโดยใช้วิธีการศึกษาเอกสาร การสังเกตการณ์ และท้ายสุดจะเป็นการสัมภาษณ์ พนักงานสอบสวน และผู้บังคับบัญชาของกองกำกับการ 2 กองบังคับการปราบปรามการกระทำความผิดเกี่ยวกับอาชญากรรมทางเศรษฐกิจ จำนวน 10 คน ผลการวิจัย พบว่า ปัญหาและอุปสรรคในการพัฒนาประสิทธิภาพการบริหารจัดการงาน หลัก ๆ มาจากด้านกฎหมาย คำสั่ง และระเบียบที่เกี่ยวข้องในการปฏิบัติงานที่ล้าสมัย สร้างความยุ่งยาก และไม่สนับสนุนความก้าวหน้าของพนักงานสอบสวน ด้านปริมาณงานแต่ละคดีที่มีเป็นจำนวนมากและเวลาในการทำสำนวนการสอบสวนที่น้อย ด้านสมรรถนะของพนักงานสอบสวนที่ยังไม่เพียงพอ ด้านค่าใช้จ่ายที่มีเรื่องการเบิกค่าสำนวนการสอบสวนได้ล่าช้า ส่วนแนวทางในการพัฒนาประสิทธิภาพการบริหารจัดการงาน พบว่า แต่ละคนมีการวางแผนในการปฏิบัติงานที่ใกล้เคียงกัน มีการพัฒนาสมรรถนะทั้งด้านกฎหมายที่เกี่ยวข้อง ด้านภาษาต่างประเทศ ด้านเทคโนโลยี และด้านบัญชี สุดท้ายเรื่องของการดูแลสุขภาพร่างกายและจิตใจ ซึ่งถือว่าเป็นสิ่งสำคัญที่ไม่แพ้กัน |
| Other Abstract: | Inquiry Official, Sub-Division 2, Economic Suppression has duties and powers about gather evidence and implementation according the Criminal Procedure Code about taxes, including The Customs Act B.E. 2560, The Excise Tax Act B.E. 2560 and the Revenue Code. There is a trend of the number of cases and the financial damage increasing steadily since 2020 due to the outbreak of the coronavirus disease 2019 (COVID-19). It make Tourists refrain from traveling in and out of the country, The country's economy is in decline and The people are unemployed. Of course, the source of increased tax crimes. In addition, each case has a large amount of documents and procedures for each case. Compared to other divisions and local police stations under the jurisdiction of the Royal Thai Police In addition, tax law is considered a special law which is highly complex. Files cannot be transferred to the local police station for processing. Therefore, the researcher chose to do an independent Study on the topic “The Efficiency Improvement of Inquiry Official, Sub-Division 2, Economic Suppression Division” in order to find appropriate ways to develop the efficiency of managing the work of Inquiry Official, Sub-Division 2, Economic Suppression Division. The objective is to know the problems and obstacles in developing the efficiency of work management. and guidelines for developing the efficiency of work management of Inquiry Official, Sub-Division 2, Economic Suppression Division. Qualitative research was conducted to collect data by interview and documentary research, Observation. Finally, The author conducted interviews with 10 people, including Inquiry official and the commander of Sub-Division 2, Economic Suppression Division. Research finding indicate problems and obstacles in developing work management efficiency caused by outdated laws and regulations relating to work performance. That hinders support the progress of the Inquiry Official. The workload for each case is large and there is little time to complete the investigation. The competency of the investigating officers is still insufficient. In terms of expenses, there is the issue of delayed disbursement of investigation files. As for guidelines for developing the efficiency of work management, it found that each person had a similar plan for performing work. Competency needs to be improved in legal matters. Foreign languagetechnology and accounting. There is the issue of taking care of your physical and mental health which is considered equally important. |
