dc.description.abstract	กรมสอบสวนคดีพิเศษมีมาตรการในการสืบสวนและสอบสวนคดีพิเศษแตกต่างไปจากการสืบสวนและสอบสวนทั่วไปตามประมวลกฎหมายวิธีพิจารณาความอาญา กรมสอบสวนคดีพิเศษจึงมีอำนาจในการเบิกค่าใช้จ่ายสำหรับการสืบสวนสอบสวนตามาตรา 31 อย่างไรก็ตาม กรมสอบสวนคดีพิเศษยังมีข้อจำกัดด้านงบประมาณบางประการ กล่าวคือ บางปีงบประมาณมีค่าใช้จ่ายจริงที่ใช้ในการสืบสวนตามมตรา 31 มากกว่างบประมาณที่ได้รับจัดสรร และในบางปีงบประมาณ กรมสอบสวนคดีพิเศษได้มีการขอเบิกค่าใช้จ่ายเพิ่มเติม โดยกรมสอบสวนคดีพิเศษได้ขอรับการสนับสนุนงบประมาณรายจ่ายประจำปีงบประมาณ ในส่วนของงบกลาง รายการเงินสำรองจ่ายเพื่อกรณีฉุกเฉินหรือจำเป็น เพื่อนำงบประมาณดังกล่าวมาเป็นค่าใช้จ่ายในการสืบสวนสอบสวนคดีพิเศษ นอกจากนั้น หากเจ้าหน้าที่ผู้ปฏิบัติงานถูกดำเนินคดีอาญาและพนักงานอัยการไม่รับว่าความให้ ย่อมส่งผลให้เจ้าหน้าที่ผู้ปฏิบัติงานต้องดำเนินคดีด้วยตนเอง และยังต้องใช้งบประมาณส่วนตัวสำหรับการดำเนินคดี ด้วยเหตุผลที่กล่าวมาข้างต้น ผู้ศึกษาวิจัยจึงเห็นว่าควรมีการจัดตั้งกองทุนเพื่อการป้องกันและการสอบสวนคดีพิเศษ โดยให้กองทุนเพื่อการป้องกันและการสอบสวนคดีพิเศษ ประกอบด้วย ทรัพย์สินที่สามารถนำเข้ากองทุน ผู้มีอำนาจบริหารกองทุน การบริหารจัดการกองทุน และการตรวจสอบการดำเนินงานของกองทุน เพื่อช่วยแก้ไขปัญหาเรื่องข้อจำกัดด้านงบประมาณดังกล่าวข้างต้น และทำให้การดำเนินงานของกรมสอบสวนคดีพิเศษมีความคล่องตัวมากขึ้นสามารถนำเงินหรือทรัพย์สินมาสนับสนุนการป้องกันและการสอบสวนคดีพิเศษให้มีประสิทธิภาพมากยิ่งขึ้น	en_US
dc.description.abstractalternative	Department of Special Investigation (DSI) has a policy for investigation and inquiry which is different from ordinary investigation and inquiry per the Criminal Procedure Code. DSI has authority to advance expenditures for investigation and inquiry per Section 31. However, DSI has some restrictions regarding budget, for instance, in some budget year, the actual expense for the investigation per Section 31 exceeded the allocation budget. Further, in some budget year, DSI requested for additional expenditure in the annual expense budget by including in main budget in the name of reserved money for emergency or necessary matters. Furthermore, in the event that the officer has been sued in criminal proceedings and the public prosecutor does not conduct such case, the officer may have to conduct the case himself and use his own personal budget for the lawsuit. With respect to the aforesaid reason, researcher foresees that Special Case Investigation Fund should be established. The fund may consist of potential assets, authorized persons to manage fund, fund management and fund operation examination, in order to solve the problem in relation to restrictions of DSI’s budget. As a result, the operation of the DSI will have more flexibility and have more financing and assets to support and efficiently prevent, protect and investigate special case proceedings.	en_US
