| dc.description.abstract | โดยที่สภาวะการณ์ของประเทศไทยในปัจจุบัน ปรากฏว่า หน่วยงานของรัฐและเอกชนได้มีความจำเป็นที่จะต้องนำพื้นที่บริเวณชายฝั่งทะเล และที่ดินที่อยู่ใต้น้ำทะเลมาใช้ประโยชน์ทั้งในทางคมนาคม อุตสาหกรรม และพาณิชยกรรม แต่มาตรการทางกฎหมายที่ใช้บังคับอยู่ในขณะนี้ยังไม่เหมาะสม และได้เกิดปัญหา และอุปสรรคในการดำเนินการถมที่ในทะเลหลายประการทั้งที่เป็นปัญหาข้อกฎหมาย และปัญหาในทางปฏิบัติ วิทยานิพนธ์นี้ จึงมุ่งศึกษาทฤษฎี แนวความคิด ตลอดจนหลักเกณฑ์ทางกฎหมายเพื่อหาแนวทางในการแก้ไขปัญหาและอุปสรรคเกี่ยวกับการถมที่ในทะเลของประเทศไทย และจากการวิจัยได้เสนอแนะแนวทาง ในการแก้ไขปัญหาเกี่ยวกับการถมที่ในทะเลดังนี้ 1. การแก้ไขปัญหาระยะสั้น โดยรัฐเป็นผู้กำหนดนโยบายในการถมที่ในทะเลเพื่อเป็นแนวทางในการใช้ประโยชน์จากพื้นที่ที่ได้จากการถมทะเล และให้กรมเจ้าท่าเป็นผู้พิจาณาอนุญาตการขอถมที่ในทะเล โดยประสานงานกับหน่วยงานที่เกี่ยวข้อง เช่น กรมที่ดิน 2. การแก้ไขปัญหาระยะยาว โดยการเสนอแนวทางและมาตรการทางกฎหมายเกี่ยวกับการถมที่ในทะเล ในรูปแบบการบัญญัติกฎหมายเฉพาะขึ้นสำหรับประเทศไทย | en_US |
| dc.description.abstractalternative | According to the present situation, it appears that it is necessary for both government and private sectors to take into consideration on the utilization of land reclamation for the purposes of transportation, industry and commerce but the provisions of laws presently enforced have not been properly enacted, and problems and obstacles in respect of land reclamation have been arisen both in terms fo legal issues and practically. This thesis aims to study the theory, concept and provisions of laws to solve problems and obstacles on land reclamation, and purposes two solutions as follows : 1. Short-term solution : The government should specify the policy on land reclamation by appointing Department of Harbor to consider and approve the application for land reclamation by cooperating with other relevant agency such as Land Department. 2. Long-term solution : The procedures and provisions of laws in respect of land reclamation should be specifically constituted. | en_US |
