dc.description.abstract	ศึกษาและวิเคราะห์ถึงมาตรการการประเมินผลกระทบสิ่งแวดล้อม ที่บัญญัติไว้ในกฎหมายและสภาพบังคับใช้ ตลอดจนเสนอแนะแนวทางการแก้ไขปรับปรุงมาตรการดังกล่าว ทั้งนี้เพื่อให้การบังคับใช้มาตรการการประเมินผลกระทบสิ่งแวดล้อม เป็นไปได้อย่างมีประสิทธิภาพมากยิ่งขึ้น ผลจากการศึกษาวิจัยพบว่า ถึงแม้นว่าประเทศไทยจะได้นำมาตรการการประเมินผลกระทบสิ่งแวดล้อม เข้ามาใช้บังคับเพื่อป้องกันปัญหาผลกระทบสิ่งแวดล้อม อันเนื่องมาจากการดำเนินโครงการหรือกิจการพัฒนาต่างๆ ตามบทบัญญัติแห่งพระราชบัญญัติส่งเสริม และรักษาคุณภาพสิ่งแวดล้อมแห่งชาติก็ตาม แต่เมื่อพิจารณาถึงการบังคับใช้มาตรการดังกล่าวในปัจจุบัน กลับประสบปัญหาในเรื่อง เนื้อหาในบทบัญญัติของกฎหมาย ที่มีผลใช้บังคับยังคงมีลักษณะที่จำกัด และแนวนโยบายของฝ่ายบริหารในการบังคับใช้มาตรการนี้ยังขาดความชัดเจน นอกจากนี้บทบาท อำนาจ หน้าที่ขององค์กรที่เกี่ยวข้องกับการบังคับใช้กฎหมาย ก็ยังไม่มีประสิทธิภาพเพียงพอในการป้องกันปัญหาผลกระทบสิ่งแวดล้อม ที่เกิดขึ้นในปัจจุบัน จากสภาพปัญหาดังกล่าว ผู้วิจัยจึงได้เสนอแนะให้มีการดำเนินการปรับปรุง และแก้ไขเพิ่มเติมบทบัญญัติของกฎหมายที่ยังคงมีข้อบกพร่องอยู่ เพื่อให้เกิดความเหมาะสมที่จะนำมาใช้บังคับ พร้อมทั้งเสนอแนะให้การพิจารณาทบทวนถึงแนวนโยบายของฝ่ายบริหาร โดยเฉพาะอย่างยิ่งมติคณะรัฐมนตรี ในเรื่องที่มีความเกี่ยวข้องกับมาตรการการประเมินผลกระทบสิ่งแวดล้อม เพื่อให้สอดคล้องและเป็นไปในแนวทางเดียวกันกับบทบัญญัติของกฎหมาย ตลอดจนเสนอแนะให้มีกำหนดบทบาท อำนาจ หน้าที่ขององค์กรที่เกี่ยวข้องกับการบังคับใช้กฎหมาย แต่ละองค์กรอย่างชัดเจนและเหมาะสม ก็จะเป็นอีกแนวทางหนึ่งที่จะทำให้การบังคับใช้ มาตรการการประเมินผลกระทบสิ่งแวดล้อมเป็นไปอย่างมีประสิทธิภาพมากยิ่งขึ้น ผลที่ตามมาก็คือปัญหาผลกระทบสิ่งแวดล้อมอันเนื่องมาจากการดำเนินโครงการ หรือกิจการพัฒนาต่างๆ ย่อมจะบรรเทาเบาบางจนกระทั่งลดน้อยลงไปในที่สุด	en
dc.description.abstractalternative	To study and analyze the measure to assess the environmental impact as stipulated in the laws and the enforcement of such measure. In addition, this research will propose the advice for improvement of such measure in order that the measure for the assessment of the environment will be enforced much more effectively. From the study, it is found that the enforcement of the measure to assess and prevent the environmental impact pursuant to the Enhancement and Conservation of National Environmental Quality Act has the probelm due to the limited implementation of the provisions stupulated in the Act and the executive policy for enforcement this measure still not previous and the ineffiency of the relevant governmental organization all these problems effect the enforcement of environmental impact assessment measure ineffiency for prevent the environmental impact problem in the present situation. From the nature of such problems, the researcher suggests improvement and adjustment of deficient provisions of the laws in order to make such provisions suitable for the use in the present situation. For the purpose of the consistency with the provisions of the law, the research also suggests review of the executive policy, especially the cabinet resolution concerning the measure for assessment of the environmental impact. Furthermore, the governmental organization involving the implementation of the said measure should be imposed the definitive role, authority and duty.	en
