dc.description.abstract	จากการศึกษาพบว่าอนุสัญญาสหประชาชาติว่าด้วยกฎหมายทะเล ค.ศ.1982 ได้กำหนดสิทธิของ รัฐไร้ชายฝั่งไว้ 2 เรื่องสำคัญคือ สิทธิในการเข้าและออกสู่ทะเล และ เสรีภาพในการผ่าน แต่อนุสัญญาฯ ได้กำหนดเพียงกรอบกว้างๆ เท่านั้นไม่สามารถนำไปปฏิบัติได้ทันที จึงกำหนดให้รัฐที่เกี่ยวข้องจัดทำ ข้อตกลงในระดับภูมิภาค อนุภูมิภาค หรือระดับทวิภาคีเพื่อกำหนดรายละเอียดในการปฏิบัติตามสิทธิ ของรัฐไร้ชายฝั่ง แต่เนื่องจากประเทศไทยยังไม่ได้เป็นภาคีแห่งอนุสัญญาสหประชาชาติว่าด้วยกฎหมาย ทะเล ค.ศ.1982 ดังนั้นประเทศไทยจึงยังไม่มีพันธกรณีต่อสาธารณรัฐประชาธิปไตยประชาชนลาวใน เรื่องเกี่ยวกับสิทธิของรัฐไร้ชายฝั่งตามอนุสัญญาดังกล่าว แต่ในข้อเท็จจริงพบว่าปัจจุบันประเทศไทยกับสาธารณรัฐประชาธิปไตยประชาชนลาวมีความ ร่วมมือกันเกี่ยวกับการขนส่งผ่านแดน โดยเห็นได้จากความตกลงต่างๆ หลายฉบับทั้งในระดับภูมิภาค อนุภูมิภาค และทวิภาคีระหว่างสองประเทศ ซึ่งเพียงพอต่อการนำไปปฏิบัติในเรื่องการขนส่งผ่านแดน ระหว่างประเทศ และในทางปฏิบัตินั้นพบว่าปัญหาต่างๆ ในอดีตเกี่ยวกับการขนส่งผ่านแดนไทย-ลาว เช่น ปัญหา การผูกขาดของผู้ประกอบการขนส่งได้รับการแก้ไขไปแล้ว แต่ปัจจุบันยังมีปัญหาเล็กน้อยในทางปฏิบัติ เช่น ความล่าช้าจากระบบการผ่านแดน ความเข้าใจในการปฏิบัติของเจ้าหน้าที่ทั้งสองฝ่ายไม่สอดรับกัน เป็นต้นซึ่งจำต้องได้รับการแก้ไขและพัฒนาต่อไป
dc.description.abstractalternative	The study found that United Nation Convention on the Law of the Sea 1982 set up two main rights of land locked state: The rights of access to and exit from the sea and Freedom of Transit. This law was too general to immediately perform in current events. So it forced concerned states with this law as mentioned above must make agreements to follow the rights of land locked state together at a level of region, sup-region or bilateral. But Thailand has not yet been a party of United Nation Convention on the Law of the Sea 1982. Thus Thailand does not have obligations to perform to Lao People’s Democratic Republic according to the law as mentioned above. In fact, Thailand and Lao People’s Democratic Republic cooperate on transporting through both two countries according to agreements at a level of region, sub-region and bilateral. But in the past, it revealed that transportation through borders of Thailand and Laos has less problem of monopoly because it had been solved. Nowadays, there are a few problems in late transportation through border and officials in both countries have still misunderstood to follow the agreements. So they must improve and develop themselves by making understanding each other.
