dc.description.abstract	สิทธิของผู้รับจำนองเหนืออสังหาริมทรัพย์ที่ถูกเวนคืนนั้น หากพิจารณาจากบทบัญญัติแห่งพระราชบัญญัติว่าด้วยการเวนคืนอสังหาริมทรัพย์ พ.ศ. 2530 มาตรา 29 จะพบว่ากล่าวไว้เพียงสิทธิในการขอรับชำระหนี้ หรือขอรับชดใช้จากเงินค่าทดแทนสำหรับอสังหาริมทรัพย์ที่ถูกเวนคืนเท่านั้น เมื่อได้พิจารณาถึงสิทธิของผู้รับจำนองตามประมวลกฎหมายแพ่งและพาณิชย์แล้วมาตรา 702 กำหนดให้สิทธิจำนองเป็นทรัพยสิทธิที่ติดตามไปกับอสังหาริมทรัพย์นั้น ไม่ว่าจะได้มีการโอนกรรมสิทธิ์ไปยังบุคคลอื่นด้วยวิธีการใดก็ตาม ผู้รับโอนต้องรับเอาจำนองติดมากับอสังหาริมทรัพย์นั้นด้วยจนกว่าจะได้มีการไถ่ถอนจำนอง และหากมีการบังคับจำนองเจ้าหนี้ผู้รับจำนองจะได้รับชำระหนี้จากอสังหาริมทรัพย์ที่จำนองนั้นก่อนเจ้าหนี้สามัญ แต่โดยผลของการตราพระราชบัญญัติเวนคืนอสังหาริมทรัพย์ส่งผลให้สิทธิจำนองสิ้นสุดลง โดยผู้รับจำนองไม่สามารถใช้สิทธิในฐานะเจ้าหนี้มีประกันเหนืออสังหาริมทรัพย์นั้นได้ดังเดิม คงมีเพียงสิทธิในการขอรับชำระหนี้หรือขอรับชดใช้จากเงินค่าทดแทนเท่านั้น บทบัญญัติของพระราชบัญญัติว่าด้วยการเวนคืนอสังหาริมทรัพย์ พ.ศ. 2530 มาตรา 29 จึงไม่อาจคุ้มครองสิทธิของเจ้าหนี้ผู้รับจำนองได้อย่างเพียงพอในลักษณะที่เทียบเท่า หรือใกล้เคียงกับสิทธิที่ผู้รับจำนองมีอยู่ตามประมวลกฎหมายแพ่งและพาณิชย์ จากการศึกษาวิจัย ผู้เขียนเสนอว่าควรให้มีการแก้ไขเพิ่มเติมบทบัญญัติของพระราชบัญญัติว่าด้วยการเวนคืนอสังหาริมทรัพย์ พ.ศ. 2530 โดยให้สิทธิแก่ผู้รับจำนองทั้งในเรื่องการต่อรองราคาหรือจำนวนเงินค่าทดแทนอสังหาริมทรัพย์ที่ถูกเวนคืน การอุทธรณ์ต่อรัฐมนตรีผู้รักษาการฯ และการฟ้องคดีต่อศาลกรณีที่ไม่พอใจในจำนวนค่าทดแทนที่ได้รับ จะเป็นการคุ้มครองสิทธิของผู้รับจำนองให้ได้รับความเสียหายน้อยที่สุดจากการเวนคืนอสังหาริมทรัพย์
dc.description.abstractalternative	The mortgagee‘s rights over the expropriation according to The Expropriation Act A.D. 1987, Section 29 mentions only the right over debt payable or reimburses from compensation over the expropriation. In considering the Civil and Commercial Code, Section 702, the mortgagee's rights is indivisible with the property, even though property is transferred the ownership to other people by any process. The transferee is subject to accept the mortgage rights over the property until redemption. If there is legal enforcement of mortgage, the mortgagee will get the payment before other ordinary creditor. Nevertheless, The Expropriation Act terminates the mortgage. The mortgagee does not have the rights over property. Thus, the provision of The Expropriation Act A.D. 1987, Section 29 cannot secure the rights of the mortgagee as much as it should be according to the Civil and Commercial Code. From studying, the researcher recommends that The Expropriation Act A.D. 1987 should be amended by giving the mortgagee the rights to negotiate the compensation over expropriation, to appeal and even to sue in case of dissatisfaction of compensation. With these, the mortgagee‘s rights are able to be protected and reduce the lost of expropriation.
