dc.description.abstract	พระราชบัญญัติวิธีพิจารณาคดีผู้บริโภค พ.ศ. 2551 เป็นกฎหมายที่มีวัตถุประสงค์เพื่อคุ้มครองผู้บริโภคให้ได้รับการเยียวยาชดใช้ความเสียหายด้วยความสะดวก รวดเร็ว และประหยัด ผู้ประกอบธุรกิจจึงมีความกังวลเกี่ยวกับการบังคับใช้กฎหมายฉบับนี้อยู่หลายประการ อีกทั้งยังไม่ มีความชัดเจนในประเด็นข้อกฎหมายที่จะมีผลบังคับต่อผู้ประกอบธุรกิจ วิทยานิพนธ์ฉบับนี้จึงมุ่ง วิเคราะห์ผลกระทบที่มีต่อธุรกิจ 3 ประเภทคือ อิเล็กทรอนิกส์ ไฟฟ้า และยานยนตร์ โดยเปรียบเทียบ กับหลักการดำเนินคดีผู้บริโภคตามประมวลกฎหมายวิธีพิจารณาความแพ่งที่ใช้อยู่เดิม และ เปรียบเทียบกับกฎหมายของประเทศสหรัฐอเมริกาซึ่งเป็นประเทศที่ได้พัฒนากฎหมายคุ้มครอง ผู้บริโภคมาโดยตลอด จากการศึกษาพบว่ากฎหมายฉบับนี้มิได้ส่งผลกระทบต่อผู้ประกอบธุรกิจประเภทสินค้า แต่อย่างใด และพบว่าผู้ประกอบธุรกิจก็ได้รับประโยชน์จากการดำเนินคดีที่สะดวกและรวดเร็ว เช่นเดียวกับที่ผู้บริโภคได้รับ ซึ่งมากกว่าหลักการดำเนินคดีผู้บริโภคตามประมวลกฎหมายวิธี พิจารณาความแพ่งที่ใช้อยู่เดิม สำหรับการดำเนินคดีผู้บริโภคในประเทศสหรัฐอเมริกาไม่มี กฎหมายวิธีพิจารณาคดีผู้บริโภคโดยตรง แต่เป็นกฎหมายวิธีพิจารณาคดีทั่วไปและมีหลักการดำเนินคดีแบบกลุ่ม (class action) ทำให้ผู้ประกอบธุรกิจไม่ต้องถูกดำเนินคดีหลายครั้ง อีกทั้งผล ของคำพิพากษาก็มีความเป็นเอกภาพ ผู้วิจัยเห็นว่าหากนำหลักการดำเนินคดีแบบกลุ่มมาใช้ใน ประเทศไทยก็น่าจะเป็นประโยชน์ และได้เสนอแนวทางเกี่ยวกับภาระการพิสูจน์ซึ่งเป็นเรื่องสำคัญ ของพระราชบัญญัติวิธีพิจารณาคดีผู้บริโภค พ.ศ. 2551 ให้ผู้ประกอบธุรกิจประเภทสินค้าผู้สุจริต ได้เตรียมพร้อมเกี่ยวกับข้อมูลในกระบวนการผลิตและเอกสารที่แสดงถึงคุณสมบัติของสินค้าใน การพิสูจน์ในกรณีที่สินค้านั้นเกิดความเสียหายต่อผู้บริโภค	en_US
dc.description.abstractalternative	Consumer Case Procedure Act B.E. 2551 was enacted in order to provide the speedy remedy to the consumer at a lower legal action expenses. Nevertheless, in views of the business operators, there have been various concerns to the enforcement of this Act in that some legal issues regarding in particular the restrictions imposed upon the business operators remain rather confusing. This thesis focus on the impacts of such law towards the businesses relating to electronic, electric products, and automobiles, and then compares this Act with the consumer protection under the existing civil procedure, and the US laws which has continual development on the consumer protection law. It appears from this study that this act does not provide any negative effect upon the business operators. Instead, the business operators also benefit from the continual proceeding in the same manner as the consumer does whereas these attributes has never existed in the civil procedure. In the US, although there is no specific law on consumer case procedure but the civil procedure and particularly the class action will prevent the business operators from the repeating trials, and thereby creates the unity in the court rulings. It is found that the class action, if imported to Thai legal procedure, will be of significant benefit. This thesis also demonstrates in detail the issue concerning the burden of proof which is regarded another core value of this act in order that the good faith business operators will be able to prepare the information relating to the production process, and the document manifesting the quality of the goods to knock out the allegation that the consumer suffers damage from such goods.	en_US
