Abstract:
เป็นที่รับรู้กันอยู่ทั่วไปในทางกฎหมายระหว่างประเทศว่า การใช้กำลังเป็นสิ่งต้องห้ามในการดำเนินความสัมพันธ์ระหว่างประเทศตั้งแต่มีกฎบัตรสหประชาชาติเป็นต้นมา แต่ทั้งนี้ ในกฎบัตรสหประชาชาติมีข้อยกเว้นที่สำคัญของหลักการห้ามใช้กำลังดังกล่าวอยู่ คือ กรณีการใช้กำลังป้องกันตัวเอง ตามมาตรา 51 แต่อย่างไรก็ตาม หากพิจารณาเฉพาะกฎบัตรสหประชาชาติมาตรา 51 จะพบว่า รัฐมีสิทธิใช้กำลังป้องกันตนเองเฉพาะในกรณีที่ถูกโจมตีด้วยอาวุธเท่านั้น ซึ่งหากพิจารณาสิทธิดังกล่าวเฉพาะลายลักษณ์อักษรอาจพบว่า ไม่สอดคล้องกับสภาพความรวดเร็ว และรุนแรงของภัยคุกคามรูปแบบใหม่ๆ ในปัจจุบัน ซึ่งเปลี่ยนไปมากจากช่วงเวลาที่ก่อตั้งองค์การสหประชาชาติ หากศึกษาวิวัฒนาการของหลักกฎหมายว่าด้วยการห้ามใช้กำลัง และค้นหาแนวปฏิบัติของรัฐที่เกี่ยวข้อง รวมทั้งแนวคิดทางวิชาการ และแนวคำพิพากษาของศาลยุติธรรมระหว่างประเทศแล้วอาจพบว่าการใช้สิทธิป้องกันตัวเองล่วงหน้าก่อนที่จะถูกโจมตีด้วยอาวุธซึ่งเป็นเงื่อนไขที่กำหนดอยู่ในกฎบัตรสหประชาชาติมาตรา 51 เพื่อป้องปัดภัยคุกคามนั้นให้พ้นไปก่อนที่จะเกิดขึ้น นั้นเป็นที่ยอมรับได้ในทางกฎหมายระหว่างประเทศในบางกรณี โดยต้องมีหลักเกณฑ์ และเงื่อนไขบางประการ โดยเฉพาะอย่างยิ่งจำเป็นจะต้องมีความใกล้จะเกิดของภัยอย่างยิ่ง
