dc.description.abstract	วิทยานิพนธ์นี้ต้องการศึกษาว่าภายใต้พระราชบัญญัติการสอบสวนคดีพิเศษ พ. ศ. 2547 ควรมีมาตรการควบคุมการแสวงหาพยานหลักฐานโดยการสืบสวนสอบสวนด้วยวิธีการแฝงตัวอย่างไรเพื่อจะได้เป็นหลักประกันสิทธิเสรีภาพรองประชาชน และคุ้มครองเจ้าหน้าที่ของรัฐในการปฏิบัติหน้าที่สืบสวนสอบสวนด้วยวิธีกาแฝงตัว จากการศึกษาพบว่าฯพระราชบัญญัติการสอบสวนคดีพิเศษพ. ศ. 2547 ให้อำนาจอธิบดีกรมสอบสวนคดีพิเศษ หรือผู้ได้รับมอบหมาย มีอำนาจอนุญาตให้บุคคลใด เข้าไปสืบสวนสอบสวนในคดีพิเศษด้วยวิธีการแฝงตัว เข้าไปในองค์กรหรือกลุ่มบุคคลใด เพื่อค้นหาและรวบรวมพยานหลักฐานตลอดจนมีอำนาจให้จัดทำเอกสาร หรือหลักฐานใดขึ้น เพื่อประโยชน์ในการสืบสวนสอบสวนในคดีพิเศษโดยไม่มีองค์กรภายในหรือภายนอกตรวจสอบอำนาจของอธิบดีกรมสอบสวนคดีพิเศษทำให้เกิดความไม่โปร่งใสในการใช้อำนาจรองอธิบดีซึ่งแตกต่างจากหลักการอนุญาตให้มีการสืบสวนสอบสวนด้วยวิธีการแต่งตัวของสำนักงานสืบสวนสอบสวนกลาง (F. B.I.) ของประเทศสหรัฐอเมริกา ซึ่งจะมีคณะกรรมการทบทวนการอนุญาตให้มีการสืบสวนสอบสวนด้วยวิธีการแฝงตัวตรวจสอบการใช้อำนาจอนุญาตของผู้ใช้อำนาจอนุญาตให้มีการสืบสวนสอบสวนด้วยวิธีการแฝงตัวทำให้เกิดความโปร่งใสในการปฏิบัติการสืบสวนสอบสวนด้วยวิธีการแฝงตัวจึงสมควรนำเอาหลักการตรวจสอบถ่วงดุลอำนาจอนุญาตให้มีการสืบสวนสอบสวนด้วยวิธีการแฝงตัวที่มีใช้อยู่ในสำนักงานสืบสวนสอบสวนกลาง (F. B.I.) ประเทศสหรัฐอเมริกามาเป็นแนวทางในการตรวจสอบถ่วงดุลย์การใช้อำนาจอนุญาตให้มีการสืบสวนสอบสวนด้วยวิธีการแฝงตัวของอธิบดีกรมสอบสวนคดีพิเศษตามนาฎหมายนี้สำหรับการรับฟังพยานหลักฐานที่ได้มาจาการสืบสวนสอบสวนด้วยวิธีการแฝงตัวนั้นตามแนวคำพิพากษาฎีกาจนถึงปัจจุบันศาลยอมรับฟังพยานหลักฐานที่ได้มาจากการสืบสวนลีกาสวนด้วยวิธีการแฝงตัวลงโทษจำเลยได้แต่จะต้องเป็นพยานหลักฐานที่มิได้เกิดขึ้นโดยไม่ชอบด้วยกฎหมายหรือเป็นพยานหลักฐานที่เกิดขึ้นจากการล่อลวงให้มีการกระทำความผิดจึงสมควรส่งเสริมให้ใช้วิธีการสืบสวนสอบสวนด้วยวิธีการแฝงตัวหาพยานหลักฐานลงโทษผู้กระทำความผิดต่อไป
dc.description.abstractalternative	The study shows that pursuant to the Act of Special Investigation B E.2547 The Director General of the Department of Special Investigation and the person assigned by the Director General are competent to give any persons the permission to conduct the special investigation by undercover operation into any organization or any group foe the purposes of searching and gathering the evidence and providing the document or any evidence by mean of the special investigation. The aforementioned power of the D irector G eneral is doubtful b ecause it is with out i nternal or external inspection Unlike the Thailand's system, the America's system is much transparent. Any permission to conduct the special investigation by undercover operation of Federal Bureau of Investigation(F.B.I) of the United State of America will be inspected by the Commission for the Review of the Permission for Undercover Investigation. The Inspection System of the United State of America which is mare transparent than that of Thailand should therefore be adjusted and used in Thailand in order to develop the check and balance system regarding the power of Director General of the Department of special Investigation under the Act of special Investigalion B.E.2547 Any evidence, obtained from the undercover operation, if it is not obtained Through the unlawful process or entrapment, is admissible. The undercover operation therefore is one of the best ways for gathering of evidence for crime control operation which can bring the wrong doer into justice at last.
