dc.description.abstract	สารนิพนธ์ฉบับนี้เป็นวิจัยประเภทโครงการแปลในหัวข้อ ‘การแปลศัพท์เฉพาะทางในข้อเสนอกฎหมายการบริการดิจิทัลและข้อเสนอกฎหมายการตลาดดิจิทัลของสหภาพยุโรป’ มีวัตถุประสงค์ 1) เพื่อศึกษาทฤษฎีและแนวทางด้านการแปลที่เกี่ยวข้อง รวมทั้งศึกษาแนวทางการวิเคราะห์ตัวบทประเภทกฎหมาย 2) เพื่อศึกษาและรวบรวมข้อมูลเกี่ยวกับกฎหมายการให้บริการดิจิทัลและกฎหมายการตลาดดิจิทัล 3) เพื่อศึกษาแนวทางการสร้างคำศัพท์และบัญญัติศัพท์เฉพาะทาง 4) เพื่อแปลคำศัพท์เฉพาะทางเกี่ยวกับกฎหมายดิจิทัลจากข้อเสนอกฎหมายการให้บริการดิจิทัลและข้อเสนอกฎหมายการตลาดดิจิทัลในส่วนของบทนิยามและอภิธานศัพท์ที่คณะกรรมาธิการยุโรปจัดทำขึ้นในเว็บไซต์ของตน และ 5) เพื่อแปลตัวบทคัดสรรจากภาษาอังกฤษเป็นภาษาไทยจากข้อเสนอกฎหมายทั้งสองฉบับ ผู้วิจัยได้ตั้งสมมติฐานไว้ว่า การแปลคำศัพท์เฉพาะทางเกี่ยวกับกฎหมายดิจิทัลและตัวบทคัดสรรในข้อเสนอกฎหมายการให้บริการดิจิทัลและกฎหมายการตลาดดิจิทัลให้สามารถถ่ายทอดความหมายได้ครบถ้วนและเหมาะสมนั้น จะต้องใช้วิธีการแปลบัญญัติศัพท์ทั้งหมดสามวิธี ได้แก่ 1) วิธีทาบเทียบ (mapping-matching) 2) วิธียืมตรง (direct borrowing) 3) วิธียืมตรงโดยมีคำอธิบายเสริมสั้น ๆ ผลการศึกษาในภาพรวมสนับสนุนสมมติฐานโดยพบว่า วิธีการแปลบัญญัติศัพท์ด้วยวิธีทาบเทียบ (mapping-matching) สามารถนำมาใช้ได้กับคำศัพท์ที่คัดสรรทั้งหมด 17 คำ เช่น Content moderation, Digital Services Coordinator, Very Large Online Platforms คำกลุ่มนี้จะเป็นคำที่ความหมายสามารถนำคำไทยที่มีอยู่แล้วมาแปลเทียบรายคำได้ เนื่องจากมีความหมายไม่ซับซ้อนหรือมีความหมายคนที่ภาษาไทยมีคำที่ใช้แทนความหมายได้อย่างตรงตัวอยู่แล้ว วิธีการแปลบัญญัติศัพท์ด้วยวิธียืมตรง (direct borrowing) สามารถนำมาไปใช้กับคำศัพท์ที่คัดสรรทั้งหมดสามคำ ได้แก่ online interface, cloud computing services, และ software application คำกลุ่มนี้จะเป็นคำที่มีใจความที่ใหม่สำหรับวัฒนธรรมไทย และมีความหมายค่อนข้างซับซ้อน ทำให้ไม่มีคำไทยเดิมที่เหมาะแก่การนำมาใช้เพื่อสื่อความได้อย่างสั้นและกระชับ วิธีการแปลบัญญัติศัพท์ด้วยวิธียืมตรงโดยมีคำอธิบายเสริมสั้น ๆ ไม่ปรากฏคำศัพท์คัดสรรที่ต้องใช้วิธีนี้ในการแปล นอกจากนี้ วิธีการแปลนอกเหนือจากสมมติฐานที่ผู้วิจัยนำมาใช้มีสามวิธี ได้แก่ 1) แปลโดยการใช้คำศัพท์ที่มีอยู่แล้วประกอบคำอธิบายเพิ่มเติมและใช้แนวทางการบัญญัติศัพท์ด้วยวิธีทาบเทียบ (mapping-matching) (8 คำ) 2) แปลแบบตีความและใช้แนวทางการบัญญัติด้วยวิธีแปลยืม (loan translation) ในส่วนหนึ่งของคำและแปลโดยใช้วิธียืมตรง (direct borrowing) ในอีกส่วนหนึ่ง (1 คำ) และ 3) แปลแบบตีความและใช้แนวทางการบัญญัติด้วยวิธีทาบเทียบ (mapping-matching) ในส่วนหนึ่งของคำและแปลโดยใช้วิธียืมตรง (direct borrowing) ในอีกส่วนหนึ่ง (1 คำ)
dc.description.abstractalternative	This special research is a translation project under the title ‘TRANSLATION OF TECHNICAL TERMS IN THE PROPOSAL FOR DIGITAL SERVICES ACT AND THE PROPOSAL FOR DIGITAL MARKETS ACT OF EUROPEAN UNION.’ The objectives are to: 1) study relevant translation theories and approaches as well as study approaches to analyze a legal text; 2) study and gather information about Digital Services Act and Digital Markets Act; 3) study word formations and technical term coinage approaches; 4) translate technical terms in the proposal for Digital Services Act and the proposal for Digital Markets Act in part of definitions and a glossary set out by the European Commission on its website; and 5) translate selected texts from English into Thai from the proposals for those two acts. The researcher has hypothesized that the translation of technical terms of digital laws and selected texts in the proposal for Digital Services Act and the proposal for Digital Markets Act with complete and suitable conveyance of meaning needs the following three coinage translations: 1) mapping-matching; 2) direct borrowing; and 3) direct borrowing with a brief supplementary description. An overall study result supports the hypotheses, revealing that the coinage translation by mapping-matching can be applied to 17 selected terms, such as Content moderation, Digital Services Coordinator, and Very Large Online Platforms. The terms of this group have meaning that can be translated word-by-word by analogously using existing Thai words since the meaning is not complicated or can be literally substituted by Thai words. The coinage translation by direct borrowing can be applied to three selected terms, namely online interface, cloud computing services, and software application. The terms of this group contain ideas that are new to Thai culture and have somewhat complicated meaning—thus, there are no existing Thai words suitable for short and brief conveying of ideas. The coinage translation by direct borrowing with a brief supplementary description applied to no selected terms. Aside from the assumptions, there are three additional translation methods: 1) translation by using existing Thai words with supplementary description and using a mapping-mapping coinage approach (8 terms); 2) interpretive translation and using a loan translation coinage approach on one part and translation by direct borrowing on the other part (1 term); and 3) interpretive translation with a mapping-mapping coinage approach on one part and translation by direct borrowing on the other part.
