| dc.description.abstract | ธุรกิจท่องเที่ยวเชิงเกษตรช่วยสร้างงานและรายได้ให้กับเกษตรกรและชุมชนในแหล่งท่องเที่ยวเชิงเกษตร อันเป็นการพัฒนาเศรษฐกิจ สังคม วัฒนธรรมและสิ่งแวดล้อมของชุมชนในท้องถิ่น การปรับใช้กฎหมายและมาตรการทางกฎหมายให้ความคุ้มครองนักท่องเที่ยวเชิงเกษตรในปัจจุบันกระจัดกระจายอยู่ตามกฎหมายฉบับต่างๆ ทำให้การปรับใช้กฎหมายให้ความคุ้มครองนักท่องเที่ยวเชิงเกษตรที่ผ่านมาไม่มีเอกภาพ ประกอบกับสภาวการณ์ในปัจจุบันธุรกิจท่องเที่ยวเชิงเกษตรยังมิได้มีระบบการบริหารจัดการที่ถูกต้องและเหมาะสม เป็นเหตุให้ธุรกิจท่องเที่ยวเชิงเกษตรไม่ได้รับการพัฒนาอย่างเต็มที่ นำมาซึ่งผลกระทบทั้งทางตรงและทางอ้อมต่อระบบเศรษฐกิจ สังคม วัฒนธรรม และสิ่งแวดล้อม และเป็นอุปสรรคในการพัฒนาอุตสาหกรรมท่องเที่ยวของประเทศให้มีคุณภาพและมีความยั่งยืน จากที่ได้วิเคราะห์ข้อมูลมาทั้งหมดแล้ว แม้ว่าพระราชบัญญัติคุ้มครองผู้บริโภค พ.ศ. 2522 แก้ไขเพิ่มเติมโดย พระราชบัญญัติคุ้มครองผู้บริโภค (ฉบับที่ 2) พ.ศ. 2541 และ พระราชบัญญัติวิธีพิจารณาคดีผู้บริโภค พ.ศ. 2551 เป็นกฎหมายที่นำมาปรับใช้กับการให้ความคุ้มครองนักท่องเที่ยวเชิงเกษตรได้ดีกว่ากฎหมายฉบับอื่น แต่กฎหมายฉบับดังกล่าวยังมีบทบัญญัติที่ไม่เหมาะสมกับการให้ความคุ้มครองนักท่องเที่ยวเชิงเกษตร ดังนั้น ภาครัฐควรบัญญัติกฎหมายเพื่อให้ความคุ้มครองนักท่องเที่ยวเชิงเกษตรไว้เป็นการเฉพาะ (Sui generis) รวมถึงกำหนดให้มีกลไกในการกำหนดนโยบายและการบริหารจัดการการธุรกิจท่องเที่ยวเชิงเกษตรของประเทศให้มีเอกภาพตลอดจนเพื่อให้มีระบบการบริหารจัดการแหล่งท่องเที่ยวเชิงเกษตรอย่างถูกต้องและเหมาะสม อันเป็นการสร้างความมั่นใจให้กับนักท่องเที่ยวเชิงเกษตรและเป็นการส่งเสริมและสร้างความสมดุลให้กับธุรกิจท่องเที่ยวเชิงเกษตรในประเทศไทยให้เจริญเติบโตอย่างยั่งยืน | en |
| dc.description.abstractalternative | Agro-tourism business has produced employments and subsequently incomes for farmers and the rural communities who live in agro-tourism attractions and has developed economic affairs, society, culture and environment in the rural communities. At present, the application of laws and legal measures to protect agro-tourists has been scattered under various legislation which lacks unity for the application thereof. Simultaneously, under the current circumstances, there is no management system that is appropriate and suitable for agro-tourism business. In this regard, the agro-tourism business has not been fully developed which causes the direct and indirect impacts on the economic, social, cultural and environmental systems as well as an obstacle in the development of the tourism industry of the country to meet the quality and sustainability requirements. From the research and analysis, although the Consumer Protection Act B.E. 2522 as amended by the Consumer Protection Act (No.2) B.E. 2541 and the Consumer Case Procedure Act B.E. 2551 can be applied to protect agro-tourists which is better than other legislation for the time being, the said Acts still have inappropriate provisions to be applied for the protection of agro-tourists. Therefore, the researcher is of the opinion that the government sector should enact a law on agro-tourist protection as a specific law (Sui generis) together with the mechanisms for setting up a policy and management of agro-tourism business of the country to be unique along with having a management system that is appropriate and suitable for agro-tourism attractions in order to provide agro-tourists with confidence and to promote and to balance agro-tourism business in the country to be sustainable | en |
