| Abstract: | วิทยานิพนธ์ฉบับนี้ มีวัตถุประสงค์ที่จะศึกษากฎหมายที่ควบคุมโรงพยาบาล เอกชนในปัจจุบัน และประสิทธิภาพของกฎหมายเหล่านนี้ ในการคุ้มครองผู้บริโภคทางการใช้บริการด้านรักษาพยาบาล และหาแนวทางในการปรับปรุงเพื่อ เพิ่มประสิทธิภาพในการคุ้มครอง ทางการใช้บริการด้านการรักษาพยาบาล และ หาแนวทางในการปรับปรุงเพื่อเพิ่มประสิทธิภาพในการคุ้มครองผู้บริโภคดังกล่าวให้สอดคล้องกับสถานการณ์ปัจจุบัน การศึกษานี้ได้แสดงให้ปรากฏว่า พรบ.สถานพยาบาล พ. ศ. 2504 ไม่สามารถควบคุมสถาน บริการด้านสุขภาพที่มีอยู่ทั้งหมดได้ครบถ้วน นอกจากนั้นยังมีกฎหมายหลายฉบับที่เกี่ยวข้องกับการดำเนินการ ของโรงพยาบาลเอกชนนอกเหนือไปจาก พรบ.สถานพยาบาล พ.ศ. 2504 อนึ่ง พรบ.สถานพยาบาล พ.ศ. 2504 บทบัญญัติในเรื่องการควบคุมกำกับสถานบริการด้านสุขภาพอันมีลักษณะการให้บริการ ในเป็นบริการสุขภาพมีลักษณะประกอบในเชิงที่มีส่วนเกี่ยวข้องกับด้านวิทยาศาสตร์การแพทย์ โภชนาการ และสุขภาพอนามัยซึ่งกฎหมายปัจจุบันยังไม่ชัดเจน และมีปัญหาในการตีความอย่างยิ่ง ดังนั้น จึงควรมีบทบัญญัติกฎหมายในส่วนนี้ให้กระจ่างและชัดเจน เพื่อไม่ให้เกิดปัญหาในการ บังคับใช้อันจะก่อให้เกิดความเสียหาย ทั้งในด้านการบริหารจัดการ ตลอดจนในการดำเนินการ เพื่อให้บรรลุตามนโยบาย เกี่ยวกับการควบคุมกำกับสถานพยาบาลเอกชนด้วย การวิ เคราะห์มาตรการใน พรบ.สถานพยาบาล พ.ศ. 2504 พบว่า 1. มาตรการในการควบคุมกำกับการจัดตั้งและดำเนินการสถานพยาบาลควรต้องปรับปรุง 2. ควรเพิ่มประสิทธิภาพ ในมาตรการการกำกับดูแลภายหลังภารออกใบอนุญาต 3. ควรมีมาตรการในการพัฒนาส่งเสริมคุณภาพ ของการบริการของสถานบริการ เอกชนด้วย 4. ควร เพิ่มและปรับปรุงมาตรการในการคุ้มครองผู้บริโภคทางการแพทย์ โดยมีมาตรการให้ผู้ให้บริการไม่ละเมิดต่อสิทธิของผู้บริโภคในประการต่างๆ |
| Other Abstract: | This thesis has objectives to study the present laws for controlling private hospital and its efficiency for protection the health care consumer and to demonstrate the new concept to improve the efficiency of consumer protection in the current situation. This study shows that the Hospital Act B.E. 2504 is incapable of controlling all types or health service institutions in Thailand. Beside the Hospital Act B.E. 2504, there are other acts concerning in private hospital management. The provisions of law on the Hospital Act. B.E. 2504 concerning in controlling and monitoring all the health care and health service institutions are not clear and causes of a lot of legal problems both administration and applications. For example the health care and health service institutions provide with medical advices monitor the nutrition and provide with physical exercises etc. Therefor these provisions of law should be amended and improved to project the clear cut of object in legal administration and enforcement in controlling and monitoring all private health care and health service institution to achieve the common objectives and public health policy, The analysis of legal measures in Hospital Act B.E, 2504 revealed that :- 1. The measures in controlling and monitoring, the setting up and the operation of private hospital are inappropriate and, therefor, should be improved. 2. The measures for monitoring after licensing should be more concentrate. 3. The measures to improve the quality of service in private hospital should be developed, 4, The Measures to protect health care consumer from violation of their rights such as the right to know, should be included in the statue of law. |
