| Abstract: | วิทยานิพนธ์ฉบับนี้มุ่งที่จะศึกษาเกี่ยวกับแง่มุมทางกฎหมายของทรัพยากรประวัติศาสตร์และโบราณคดีที่พบจมอยู่ในเขตไหล่ทวีปและเขตเศรษฐกิจจำเพาะ ในปัญหาที่ว่าใครจะเป็นผู้มีสิทธิดีกว่าในทรัพยากรนั้นระหว่างรัฐชายฝั่ง รัฐเจ้าของธงหรือรัฐเจ้าของทรัพย์สินเดิม กฎหมายทางทะเล ค.ศ. 1982 ที่มีอยู่เกี่ยวกับทรัพยากรประวัติศาสตร์และโบราณคดีนั้น กล่าวถึงสิทธิเหนือทรัพย์ที่จมลงนี้อย่างไม่ชัดเจนและไร้สภาพบังคับ เมื่อรัฐสำรวจและแสวงประโยชน์ทรัพยากรดังกล่าวบริเวณที่รัฐชายฝั่งมีสิทธิอธิปไตยมีปัญหาว่ารัฐที่เข้ามาทำการสำรวจได้ละเมิดอนุสัญญากฎหมายทะเลหรือไม่ผู้เขียนได้เสนอไว้ 2 ประการดังนี้ ฝ่ายแรกเห็นว่า เมื่อไม่มีบทบัญญัติเกี่ยวกับกฎหมายระหว่างประเทศกล่าวถึง การแสวงประโยชน์จะต้องได้รับอนุญาตเสียก่อน ฝ่ายที่สองเห็นว่า การสำรวจทรัพยากรประวัติศาสตร์และโบราณคดีไม่อยู่ในบทบัญญัติของการวิจัยวิทยาศาสตร์ทางทะเล เนื่องจากความไม่ชัดเจนของบทบัญญัติของกฎหมายทะเลเกี่ยวกับทรัพย์สินที่จม ผู้เขียนเสนอแนวทางแก้ปัญหาโดยการนำกฎหมายภายในที่บัญญัติเกี่ยวกับทรัพยากรประวัติศาสตร์และโบราณคดีมาใช้ในเรื่องนี้ กรณีที่ไม่มีกฎหมายภายในเกี่ยวกับเรื่องนี้ รัฐชายฝั่งสามารถใช้สิทธิอธิปไตยในเรื่องอื่น เช่น สิ่งแวดล้อม การวิจัยวิทยาศาสตร์ทางทะเลเพื่อต่อต้านคณะสำรวจต่างด้าว |
| Other Abstract: | This thesis aims to study the legal aspects, of historical and archaeological resources, found in the continental shelf and EEZ. A number of questions may be raised as the exercise of the coastal state over that resources, the ownership over the sunken treasure, the competition of states over that such objects, coastal state, flag state or the state original of sunken treasure. Under the actual law of the sea 1982, there are some provisions regarding historical and archaeological objects. However, in the area of the rights over sunken resources, those provisions are ambiguity and insufficiency. When a state explore and exploit the resources found in the area in which coastal state excrcise sovereign rights, the question is whether controversial positions, positive and negative. Concerning positive view, there is no international law provision in this area. Exploitation must be allowed for sunken treasure. For negative view, exploration of historical objects if inconsistency with the marine scientific research provision. Owing to the unclearnees of the low of the sea provisions regarding to the sunken treasure, the author suggests a solution by adopting the domestic law and regulating into this historical and archaeological object under the EEZ and continental shelf areas. In case of lacking of the domestic law in the area, coastal state can exercise their sovereign rights in the other matters such as environment, marine scientific research against the alien exploiter. |
