| dc.description.abstract | การห้ามประกอบอาชีพหรือวิชาชีพ ตามประมวลกฎหมายอาญามาตรา 50 เป็นมาตรการหนึ่งในวิธี การเพื่อความปลอดภัย ซึ่งตัดโอกาสบุคคลผู้กระทำความผิดที่เกี่ยวกับการประกอบอาชีพหรือวิชาชีพ มาตรา การนี้มีวัตถุประสงค์ เพื่อป้องกันสังคมจากผู้ที่มีสภาพเป็นอันตรายมิให้กระทำความผิดขึ้นในอนาคต โดยมีพื้นฐานมาจากทฤษฎีป้องกันสังคมตามทฤษฎีนี้มุ่งหมายที่จะป้องกันสังคมให้พ้นจากอันตราย และป้องกันมิ ให้ผู้ประกอบอาชีพที่ติดจะกระทำความผิดในลักษณะเดียวกันเกิดความยับยั้งไม่กล้ากระทำความผิด ปัญหาที่เกิดขึ้นจากการบังคับใช้วิธีการเพื่อความปลอดภัย ตามประมวลกฎหมายอาญา มาตรา 50 คือ การที่กฎหมายไม่ได้มีข้อกำหนดห้ามผุ้ถูกห้ามประกอบอาชีพหรือวิชาชีพ กระทำการในทางอาชีพหรือวิชา ชีพ แทนบุคคลอื่นหรือใช้บุคคลอื่นกระทำการแทนโดยผู้ถูกห้ามประกอบอาชีพหรือวิชาชีพ เป็นผู้ให้คำสั่งด้วย ทำให้การบังคับมาตรการนี้ไม่บรรลุผลเท่าที่ควรและการเพิกถอนคำสั่งห้ามประกอบ อาชีพหรือวิชาชีพ ควรนำหลักเกณฑ์ในการคุมประพฤติมาใช้ได้เมื่อเพิกถอนคำสั่งห้าม ทั้งนี้เพื่อให้แน่ใจว่า สภาพเป็นอันตรายนั้นได้หมดไปแล้วจริง การห้ามประกอบอาชีพหรือวิชาชีพนั้น กระทบกระเทือนต่อสิทธิพื้นฐานของบุคคลการนำมาใช้ต้อง พิจารณาชั่งน้ำหนักระหว่างสภาพอันตรายต่อสังคมของบุคคล อันมีผลกระทบต่อความปลอดภัยของประชาชนหรือรัฐกับสิทธิเสรีภาพส่วนบุคคล หากมีการห้ามประกอบอาชีพหรือวิชาชีพแล้ว รัฐควรพิจารณาหาอาชีพอื่นรองรับบุคคลเหล่านี้ด้วยเพื่อป้องกันมิให้เกิดปัญหาทางสังคมตามมา | - |
| dc.description.abstractalternative | Prohibition of occupations or professions at the penal Code, section 50 is the measure to put out the person who is convicted of an unlawful act involving abuse of his occupations or professions. This measure aims at preventing against commission of an offence in the future and is based on the Social Defence Theory aiming at safeguarding the society from dangers as well as affording to deter some potential offenders at the same time. The problem arisen from the enforcement measure of safety by virtue of section 50 of the Penal Code is that the law does not prohibit the offender from engaging in the occupations or professions from doing so on behalf of someone else, or from having someone else do it under his instructions. This loophole might cause the enforcement measure to be impossible. As for the revocation of the prohibit order, it is suggested in this study that the court can take the probation measure of the revocation in order to make sure that all dangers are gone. Prohibition of occupations or professions affects basic individual rights, so the enforcement of this measure must be considered both the dangers and the public welfares as well as the state welfares. In addition, in order to prevent social problems, the State must provide other occupations to replace the prohibited ones. | - |
