dc.description.abstract	การศึกษานี้มีวัตถุประสงค์เพื่อศึกษาและวิเคราะห์กฎหมายที่เกี่ยวกับโรงแรมว่ามีความเหมาะสมกับลักษณะทางกายภาพของอาคารที่ดัดแปลงเพื่อดำเนินกิจการเป็นที่พักลักษณะโรงแรมว่ามีความเหมาะสมเพียงไร เพื่อนำไปสู่การนำเสนอแนวทางในการปรับปรุงกฎหมายเพื่อให้สอดคล้องเหมาะสมกับกายภาพที่เกิดขึ้น โดยจะทำการศึกษาเฉพาะกฎหมายทางด้านกายภาพที่เกี่ยวข้องกับการขออนุญาตปลูกสร้างโรงแรม ที่สามารถวัด คำนวณหรือสังเกตได้ วิธีการศึกษาใช้การสังเกตและการสัมภาษณ์ในการเก็บข้อมูลกรณีศึกษา เมื่อเก็บข้อมูลลักษณะข้อมูลทั่วไปและข้อมูลที่เกี่ยวข้องด้านความปลอดภัยแล้ว นำไปเปรียบเทียบกับกฎหมายที่เกี่ยวข้อง เมื่อวิเคราะห์ความแตกต่างหรือความขัดแย้งของประเด็นด้านกฎหมาย กับลักษณะทางกายภาพที่เกิดขึ้นจริงแล้ว จึงทำแบบสอบถามเพื่อสอบถามความเห็นจากสถาปนิกผู้เชี่ยวชาญด้านการออกแบบอาคารพักอาศัย จากการศึกษาสรุปได้ว่าสาเหตุของปัญหาที่ทำให้อาคารไม่สามารถจดทะเบียนเป็นโรงแรมถูกต้องตามกฎหมายได้นั้น มาจากหลายปัจจัยด้วยกัน ดังนี้ (1.) ปัญหาเรื่องของการให้ข้อมูลด้านการขออนุญาต มีแนวทางในการแก้ไขปัญหาคือการให้หน่วยงานที่เกี่ยวข้องอันได้แก่ สำนักควบคุมและตรวจสอบอาคาร กรมโยธาธิการและผังเมือง กระทรวงมหาดไทย สำนักการโยธาธิการ กรุงเทพมหานคร และกรมการปกครองกระทรวงมหาดไทย มีการประสานงานเพื่อเผยแพร่ข้อมูลทางสื่ออิเล็กทรอนิกส์ ในเรื่องของข้อมูลด้านการขออนุญาตโรงแรมเพื่อให้ประชาชนทั่วไปได้ทราบขั้นตอน และวิธีการในการดำเนินการขออนุญาตโรงแรม (2.) ปัญหาเรื่องกระบวนการขอออนุญาต แนวทางการแก้ไขปัญหาคือ การจัดตั้งจุดบริการเป็นจุดเดียว ให้ผู้ที่มาติดต่อเรื่องการขออนุญาตสามารถดำเนินการได้สะดวกมากขึ้น โดยมีการรวบเอาหน่วยงานที่เกี่ยวข้องมาไว้ ณ สถานที่เดียวกัน(3.) กฎหมายด้านกายภาพที่เกี่ยวข้อง แนวทางการแก้ไขปัญหาคือ การกำหนดกฎเกณฑ์การพิจารณาให้ใบอนุญาตจัดตั้งและเปิดดำเนินกิจการโรงแรมให้มีความสอดคล้องกับลักษณะและสภาพโรงแรมที่แตกต่างกันไป โดยเปรียบเทียบให้สอดคล้องกับอาคารเดิม	en_US
dc.description.abstractalternative	This thesis has two main objectives, which are (1) to study the current “Building Permission of Hotel Type under Thai Building Law” that is suitable for every existing hotel in terms of physical structure, especially for hotel adaptations that exist in large quantity in Bangkok, and (2) to analyze the current situation from involved parties such as hotel entrepreneurs, hotel guests, and architects. The analytic results will be guidelines for the improving “Building Permission of Hotel Type under Thai Building Law” in the future. The scope of the thesis is primarily concerned with hotel permission in regards to the physical structure of the building, which is limited to measurable and quantifiable factors. The results were collected through the use of literature review, observation, interviews and a questionnaire. Results from the research were then compared to the existing laws. From the thesis study, the analysis showed that the reasons why hotel adaptations can’t be applied for under the current licensing based on the following factors: (1.) Lack of relevant information during the permission process. This problem can be solved by improving the level of cooperation among 3 main related organizations, which include the Department of Public Works and Town & Country Planning, the Public Works Department, and the Department of Provincial Administration, in order to provide information regarding the permission process through electronic publishing. (2.) The permission process, which can be solved by the creation of a one-stop service point, where applicants can complete the whole permission process. (3.) A lack of existing guidelines in regards to hotel adaptations. This problem can be solved by creating decision benchmarks for authorities in terms of considering guidelines for the specified hotel adaptation.	en_US
