| Abstract: | วิทยานิพนธ์ฉบับนี้มุ่งศึกษาปัญหาอันเกิดจากการทำงานขององค์กรช่วยเหลือผู้ประสบภัย โดยองค์กรเอกชน ในรูปแบบมูลนิธิเพื่อการกุศลที่มีผลกระทบต่อผู้ประสบภัย เจ้าพนักงานของรัฐ ผู้รับผิดชอบโดยตรง และการกระทำที่มีลักษณะเป็นการละเมิดต่อกฎหมาย จากการศึกษาพบว่าการช่วยเหลือผู้ประสบภัย รัฐได้จัดให้มีหน่วยงานรับผิดชอบช่วยเหลือโดยตรงอยู่แล้ว หากแต่หน่วยงานที่รัฐตั้งขึ้นมากลับไม่มีบทบาทเด่นชัดเหมือนกับที่องค์กรช่วยเหลือผู้ประสบภัยเอกชนในรูปแบบมูลนิธิเพื่อการกุศลที่ตั้งขึ้นมาเพื่อช่วยเสริมงานราชการ จนสามารถได้รับการยอมรับจากสังคมในระดับหนึ่ง และพบว่าสามารถลดภาระเจ้าพนักงาน ผู้รับผิดชอบโดยตรงและหน่วยงานที่เกี่ยวข้องได้ แต่ในบางกรณีพบว่าได้ส่งผลกระทบกับตัวผู้ประสบภัยที่ได้รับบาดเจ็บ และอุปสรรคต่อการปฏิบัติหน้าที่ของเจ้าพนักงาน โดยเฉพาะในส่วนที่เกี่ยวกับสภาพแวดล้อมและพยานหลักฐานไป โดยความรู้เท่าไม่ถึงการณ์ของเจ้าหน้าที่องค์กรเอกชน ก่อให้เกิดการละเมิดกฎหมายที่เกี่ยวข้อง เหตุเพราะเจ้าหน้าที่ องค์กรเอกชนเหล่านั้นไม่มีกฎหมายรองรับสถานภาพในการมีส่วนร่วมกับการปฏิบัติราชการของเจ้าพนักงานเกิดความไม่เหมาะสมขึ้นในการแสดงบทบาทการช่วยเหลือผู้ประสบภัยอันเป็นสิ่งที่รัฐได้กำหนดให้เป็นหน้าที่ของเจ้าพนักงานตามกฎหมายเท่านั้น แนวทางในการแก้ไขปัญหาในเรื่องนี้โดยศึกษารูปแบบในต่างประเทศเปรียบเทียบ และเสนอให้มีการพัฒนากฎหมายในส่วนที่เกี่ยวข้องกับการช่วยเหลือผู้ประสบภัยเช่นเดียวกับในประเทศที่มีการพัฒนางานด้านนี้ โดยมีสาระสำคัญในการควบคุมและคุ้มครองการปฏิบัติหน้าที่ของเจ้าหน้าที่องค์กรเอกชนในการที่จะเข้าเสริมการทำงานของรัฐ เพื่อให้ได้ประโยชน์สูงสุดจากการปฏิบัติหน้าที่ขององค์กรเอกชนเหล่านี้ ขณะที่หน่วยงานของรัฐที่รับผิดชอบโดยตรงก็จะต้องปรับปรุงบทบาทให้เข้มแข็งกว่าที่เป็นอยู่ เพื่อมาตรฐานในความปลอดภัยของประชาชน |
| Other Abstract: | This study intends to study the problems arising out of the assistance given by private rescue organization in the form of foundation for benevolence which affects the rescued, and governments officers in charge of the motion and often times assistance violated laws. The study reveals that rescue is mostly covered by governments agencies However, there role are overshadowed by private rescue organizations while are formal as foundations to assist the government. These private units seems to account for the respect of the public to a certain level and reduces the bureau of the governmental officers who are in charge of and thereby reduces the bureau of the injured agencies concerned. But in certain cases the rescued and affected and at times the performance of the officers are being obstructed. This is quite often in the area of circumferences and evidence Most often it happens out of lack of knowledge on the able of private rescue violations of law then follow. These organizations do not have a legal basis for official functions then unsuitable appears in the rescuing which is prescribed to be the duty of officers alone. The direction in solving this problem is to make a comparative study this propose a law reform in the area of rescue work by following the steps of those countries which has gone advancing. The emphasis would be on the control and protection of rescues who assists the states function This is to allow the most fruitful work from this private organization. At the same time the governmental agencies in charge must beef up to ensure the standard of safety of the public in general. |
