dc.description.abstract	วิทยานิพนธ์ฉบับนี้จึงมุ่งศึกษาถึงมาตรการที่เกี่ยวข้องกับการป้องกันการทุจริตในการจัดซื้อจัดจ้างภาครัฐของประเทศไทย โดยมีปัญหาว่ามาตรการควบคุมตรวจสอบการจัดซื้อจัดจ้างภาครัฐ ทั้งมาตรการทางกฎหมายและมาตรการทางจริยธรรมไม่สามารถแก้ไขปัญหาได้อย่างมีประสิทธิภาพ ดังนั้น ผู้เขียนจึงได้ศึกษาถึงแนวความคิดอันเป็นมาตรการที่เกี่ยวกับการป้องกันการป้องกันการทุจริตในการจัดซื้อจัดจ้างภาครัฐของประเทศไทย ตลอดจนข้อตกลงคุณธรรมที่เสนอโดยองค์กรเพื่อความโปร่งใสนานาชาติ จึงได้ศึกษาถึงแนวความคิดข้อตกลงคุณธรรมที่เสนอโดยองค์กรเพื่อความโปร่งใสนานาชาติ และจากการศึกษาพบว่าข้อตกลงคุณธรรมเป็นมาตรการที่สามารถนำมาใช้เพื่อป้องกันการทุจริตในการจัดซื้อจัดจ้างภาครัฐที่มีประสิทธิภาพอีกมาตรการหนึ่ง เนื่องจากเป็นข้อตกลงร่วมกันระหว่างหน่วยงานภาครัฐและผู้ประกอบการว่าจะดำเนินการจัดซื้อจัดจ้างด้วยความถูกต้อง โปร่งใส นอกจากนี้ ข้อตกลงคุณธรรมยังยินยอมให้มีผู้สังเกตการณ์ ซึ่งเป็นบุคคลภายนอกที่มาจากภาคประชาสังคม ที่มีความรู้ ความเชี่ยวชาญ และประสบการณ์ที่จำเป็นต่อการจัดซื้อจัดจ้างในโครงการนั้นๆ ที่ผ่านการฝึกอบรมและได้รับการรับรองความซื่อสัตย์และเป็นกลางให้เข้ามาสอดส่องดูแลและสอบทานกระบวนการจัดซื้อจัดจ้างภาครัฐอีกด้วย ดังนั้น จึงเสนอให้มีการนำแนวคิดข้อตกลงคุณธรรมมาใช้เพื่อป้องกันการทุจริตในการจัดซื้อจัดจ้างภาครัฐของประเทศไทย โดยปรับใช้ให้เหมาะสมตามบริบทของกฎหมายไทย ด้วยการกำหนดให้นำข้อตกลงคุณธรรมมาใช้บังคับกับโครงการจัดซื้อจัดจ้างภาครัฐที่มีมูลค่าตั้งแต่หนึ่งพันล้านบาทขึ้นไปหรือต่ำกว่าในกรณีที่เป็นโครงการที่มีความสำคัญ โดยกำหนดหลักเกณฑ์และขั้นตอนในการจัดทำข้อตกลงคุณธรรมให้ครบถ้วนเพื่อความโปร่งใสและตรวจสอบได้ รวมถึงกำหนดให้มีหน่วยงานรับผิดชอบในการทำหน้าที่กำหนดมาตรฐาน กำกับ ดูแล ส่งเสริมและสนับสนุนการปฏิบัติตามข้อตกลงคุณธรรมไว้ในกฎหมายกลางในระดับพระราชบัญญัติที่เกี่ยวกับการจัดซื้อจัดจ้างภาครัฐ	en_US
dc.description.abstractalternative	This thesis aims to study the measures related to the prevention of corruption in the public procurement. The corruption in the public procurement of has recently become a problem that seriously affects the development of Thailand. Neither legal nor ethical measures solve the problem effectively. Therefore, the author has studied the concepts pertaining to the prevention of corruption in public procurement in Thailand, including the integrity pact propse by the organizations to monitor the international transparency. The study found that the integrity pact has been the powerful measure that can be taken to prevent the corruption in government procurement because of the agreement between the government and the operators that the procurement is carried out with accuracy and transparency. In addition, the integrity pact allows the observers, who possess the knowledge, expertise and experience required for the procurement project, and are trained and certified of being honest and neutral, from the private sector and civil society to monitor and internal audit the public procurement. As a result, the concept of the integrity pact is proposed and introduced to prevent corruption in public procurement of Thailand by deploying the appropriate context of the law. Correspondingly, the application of the integrity pact is assigned for the public procurement project worth one billion baht or higher, or lower in the case of a project is important. The criteria and procedures for the preparation of the integrity pact are defined to ensure the transparency and monitoring. Additionally, the departments are assigned to take the responsibilities involving the establishment of the standards, and the promotion and support of the regulatory compliance. These integrity pact regulations can be instituted in the public law as an Act relating to public procurement.	en_US
