| Abstract: | อนุสัญญาสหประชาชาติว่าด้วยกฎหมายทะเล ค.ศ. 1982 ถือเป็นอนุสัญญาฉบับหนึ่งที่มีความสำคัญ ในเรื่องที่เกี่ยวกับทะเล เนื่องจากอนุสัญญาฉบับนี้ได้กำหนดสิทธิ หน้าที่และขอบเขตอำนาจของรัฐ ที่เป็นภาคีไว้มากที่สุดฉบับหนึ่ง และอนุสัญญาฉบับนี้มี 149 ประเทศทั่วโลกที่ได้ให้การยอมรับ โดย การให้สัตยาบันตามอนุสัญญาฉบับนี้ วิทยานิพนธ์ฉบับนี้ มุ่งที่จะศึกษาหลักการบังคับใช้กฎหมายใน เขตเศรษฐกิจจำเพาะตามที่อนุสัญญาฉบับนี้กำหนดไว้เป็นสำคัญ เพื่อดำเนินการหาแนวทางการ ปรับปรุงแก้ไขกฎหมายของประเทศไทยให้สอดคล้องกับอนุสัญญาฉบับนี้ให้มากที่สุด หากประเทศ ไทยจะต้องมีการให้สัตยาบันตามอนุสัญญาฉบับนี้ แนวทางการปรับปรุงแก้ไขกฎหมายที่ผู้เขียน ได้เสนอไปก็จะสามารถนำมาใช้ปรับปรุงแก้ไขกฎหมายของประเทศไทยได้ในเรื่องดังกล่าวนี้ ผลจากการศึกษาพบว่า กฎหมายของประเทศไทยบางฉบับได้กำหนดขอบเขตอำนาจกับพนักงาน เจ้าหน้าที่ของรัฐในการบังคับใช้กฎหมายไว้อย่างเพียงพอตามสิทธิที่ประเทศไทยพึงจะมีได้ในเขต เศรษฐกิจจำเพาะ แต่กฎหมายของประเทศไทยบางฉบับไม่ได้กำหนดขอบเขตอำนาจกับพนักงาน เจ้าหน้าที่ของรัฐในการบังคับใช้กฎหมายไว้อย่างเพียงพอเช่นกัน ซึ่งในส่วนนี้อาจจะส่งผลให้ ประเทศไทย อาจจะมีปัญหาในส่วนที่เกี่ยวกับการบังคับใช้กฎหมายในเขตเศรษฐกิจจำเพาะของ ประเทศไทย ดังนั้น ประเทศไทยควรจะต้องทำการปรับปรุงแก้ไขกฎหมายในส่วนที่เกี่ยวกับการบังคับ ใช้กฎหมายในเขตเศรษฐกิจจำเพาะนี้ให้มีความสอบดคล้องกับอนุสัญญาสหประชาชาติว่าด้วย กฎหมายทะเล ค.ศ. 1982 ฉบับนี้ให้มากที่สุด |
| Other Abstract: | United Nations Convention on the Law of the Sea 1982 is an important convention involving sea matters. This is due to the fact that it extensively stipulates rights, responsibilities as well as authorities of the Parties. Currently, 149 countries worldwide have deposited their ratifications. This thesis aims at studying the principle of law enforcement in the exclusive economic zone as specified in the Convention in order to find out guidelines in revising Thai laws to most conform to say Convention. That is, once Thailand ratifies it, the proposals provided in this thesis would be greatly beneficial accordingly. The study reveals that although some Thai laws suitable determine the authorities and State officials on law enforcement, some of them are still improper. Consequently, it may produce some problems in enforcing laws in Thailand{7f2019}s exclusive economic zone. Therefore, for Thailand, it is needed to revise her laws regard to law enforcement in the exclusive economic zone to most comply with United Nations Convention on the Law of the Sea 1982 |
